NRC Inspection This refers to the routine safety inspection conducted by Mr. J. F. Pang of this office on September 23, 1981 of activities authorized by NRC License No. 04-14869-01 and to the discussion of our findings held by Mr. Pang with CDR. R. Welch and other members of your staff at the conclusion of the inspection.

The inspection was an examination of the activities conducted under your license as they relate to radiation safety and to compliance with the Comission's rules and regulations and the conditions of your license. The inspection consisted of selective examinations of procedures and representative records, interviews with personnel and observations by the inspector.

During this inspection, it was found that certain of your activities appeared to be in noncompliance with NRC requirements. The items and references to the pertinent requirements are listed in Appendix A.

These items have teen categorized into severity levels as described in the Federal Register Notice (45 FR 66754) dated October 7, 1980.

Item A in the attached Notice of Violation is classified as a Severity Level III Violation in accordance with the Interim Enforcement Criteria.

As stated in Section IV.B of the Criteria, monetary civil penalties are normally assessed for Severity Level III Violations. After careful consideration of this specific violation, we have determined that civil penalties are not appropriate.

Similar violations of this type in the future may result in imposition of civil penalties.

In addition to the need for corrective action regarding the specific items of noncompliance included in Appe^1h 3, we are concerned about the implementation of your management control syst'a P +. Your response to this notice is to be submitted in accordance with the provisions of 10 CFR 2.201 as stated in Appendix A, Notice of Violation.

We have aiopted a new NRC enforcement policy, as described in the Federal Register Notice (45 FR 66754) dated October 7, 1980. With the adoption of that policy we are requiring, under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, that responses to Notices of Violations be submitted under oath c affirmation.

Therefore, the last paragraph of your later should include a statement equivalent to the following:
