Dear Mr. Silberg:
I am writing in confirmation of our telephone conversations of November 12 and 18, 1981 concerning the means of conducting discovery
-of Issue #2, the financial capability contention. As we discussed, there are pending rulemaking proceedings by the NRC which could have the effect of removing this issue from litigation.
Therefore, I have been authorized by my clients, intervenors Sunflower Alliance et.al.,
toe agree to an extension of. time to December 15, 1981 for Sunflower and the Applicant to respond to interrogatories filed by both sides.
Sunflower further agrees to review the viability of this new dead-line sometime before the 15th, to ascertain both the state of Applicant's
' responses, and the rulemaking situation.
As I previously. indicated to you,.S'unflower will be balancing your client's need for further continuances against its need as a volunteer group of intervenors to begin work on Applicant's interrogatory responses at the earliest possible date.
