Dear Madam Examiner:

I just received the League's response to Edison's motion to terminate this proceeding.

I would not normally respond to such a pleading, but I feel compelled to contra-dict Mr. Cherry's direct mistatements of fact.

In the foot-1 l

note on page 2 of the League's response, Mr. Cherry falsely states that the League has complied fully with all of Edison's discovery requests.

In fact, interrogatories filed by Edison on August 28, 1981, answers to which were due on the same date as the discovery about which the League now com-plains, were never answered.

We assume that the actual reasons for the complete breakdown in diFuovery in this proceeding will be taken up by the hearing e;caminer only if the Commis-I sion denies our motion.
