SUMMARY
OF WEEKLY INFORMATION REPORT Week Ending October 30, 1981 St. Lucie Unit 1 During eddy current testing of Unit 1, the licensee found a significant number of defective tubes (wall thickness reduced by greater than 40%). The degradation was located in the U-shaped portions of the center tubes which differs from previous experience with CE steam generators. N. S. Savannah The Nuclear Ship Savannah was moved on October 22 from the U. S. Army Depot Pier in North Charleston, S.C., to the Patriots Point Maritime Museum at Mount Pleasant, S.C. The ship will be open for public tours sometime in 1982. Technical specifications specify requirements for access control, radiation monitoring, maintenance and reporting. The S. C. Bureau of Radiological Health will be responsible for implementing these requirements. Hatch Unit'l Unit 1 was, shut down on October 9 due to increasing radiation levels in the reactor coolant. The licensee subsequently discovered between 11 and.13 leaking Suel assemblies. The NRC staff is following this event closely. No Technical Specification reporting limits were reached nor were any Technical Specifications violated. \\ g, McGuire Unit 1 NRC issued an operating license amendment to allow the licensee to store up. to 300 irradiated Oconee fuel assemblies at the McGuire site'. Clinch River Breeder Reactor The applicant has originally requested an LWA-1 by April 1983 and a CP by June 1984 in order to load fuel in February 1990. The applicant now. wishes to begin site work in Spring 1982. The CRBR Program Office's currant best estimates based on estimated review resources are issuance of an LWA-1 in August 1983 and a CP in June 1984. (See Background Information in Encl. B ofreport.) ~ Low Level Waste Storage at Reactor Sites A generic letter to utilities has been prepared for signature by the Executive Director for Operations informing utilities of the NRC licensing position on the addition of contengency storage capacity for site-generated low level waste. FY 1983 and FY 1984 Budgets The FY 1983 and FY 1984 revised budgets were submitted to 0MB on October 22.

Draft Executive Order NRC has received from the Information Security Oversight Office (IS00) a draft Executive Order to replace E.0.12065 - National Security Information. The pro-posed E.O. has been sent to NRC Office Directors for comment. While no Technical Specification {TS) reporting limits were reached nor were any.TSs violated, it was apparent to the licensee, Georgia Power Company, that there ~was leaking fuel in the core. Even though no safety hazards were presented to the public or plant staff prior to October 9, the licensee made a decision to shut down and replace the fu'el. . During a telephone report on October 23, 1981, the licensee said between 11 and 13 leaking fuel assemblies had been detected. Hatch Unit 1 is a GE Boiling Water Reactor and GE has been involved in the licensee's investigation of'these leaks. The NRC staff is following this event very closely. As no TS limits have been violated by the licensee, nor have any reporting requirements been tHggered, we have not yet received any formal correspondence. The staff has discussed this with the licensee and he has agreed to submit a Special Report on the event. ENCLOSURE B

BACKGROUND INFORMATION Status of CRBR Review as of September 15,1981 (Date CRBRPO was established) The CRBRP ER and LMFBP. Programmatic FES had not been updated'since 1977 and 1975, respectively. The CRBRP PSAR had been kept current with respect to plant design changes, but had not been updated to reflect outstanding infor-mation requests or new regulatory requirements. indefinitely in 1977 at the applicant's request and remained so.The hearing was susp Schedules The applicant had originally requested an'LWA-1 by April 1983 and a CP by June 1984 in order to load fuel in February 1990. Authorization of any pre-LWA-1 site work will require unprecedented and currently unpredictable measures. NRC Documents Needed to Support Licensing Actions The February 1977 FES and March.1977 Site Suitability Report are expected to have to be supplemented prior to the issuance of 'an LWA-1. An SER will have to be issued prior to the issuance of a CP. Currently unspecified documenta. tion is expected to be needed to support the. authorization of any pre-LWA-1 site work. CRBRPO ACTIVITIES Recent Activities During the week of October 13. meetings were held with representatives of LANL and BNL to discuss CRBRP review matters.These representatives also attended the October 14 and 15 meetings with the applicant (see below). On October 14 and 15,' meetings were held with the applicant to discuss hypothetical core disruptive accident considerations. Thermal margin beyond the design base (TMBDB) was discussed on October 14 and structural margin beyond the design base (SMBDB) was discussed on October 15. On October 16, the applicant submitted Amendment IX to the CRBR ER. Amendment IX updates the CRBRP ER in the areas of hydrology, ecology, background radiological characteristics, site preparation and plant construction and environmental monitoring. 4 On October 19 a joint RES-NRR memorandum was issued to the EDO containing ~ a schedule and procedures for the development of a comprehensive NRC plan for short-term research and technical assistance required to support CRBR licensing. This memorandum was prepared in response to the ED0's September 24 memorandum to RES and NRR. E'NCLOSURE B
~- s. . On October 20, a meeting was held with representatives of INEL to discuss INEL's capabilities to assist in the CRSRP review. On October 27-28, meetings were held with representatives of SNL, BNL and ORNL to review the current status of LMFBR research and the short-term research and technical assistance capabilities of these laboratories with respect to the CRBRP review. On October 27-29, visits were inade to the Clinch River site and a number of alternative sites in the TVA service area. The purpose of these visits was to allow the affected reviewers to obtain information needed to support their evaluations of these sites. CRBRPO's preliminary FIN plan was submitted to PPAS on October 28. The plan reflects an estimated need of $3.1 million for technical assistance in support of the CRBRP review effort for-FY 82. Planned Activities 1. Required Actions Staffing the CRBRPO Technical Review Section must be completed as soon as possible. The techiiical review branch assignments and technical assistance arrange-ments must be completed as soon as possible. These actions will depend on the technical capabilities of the CRBRPO Technical Review Section. Information needs related to certain matters which have arisen since our review was suspended in 1978 must be identified and made known to the applicant. Such matters include the November 9, 1978 Gammill-Caffey letter, the TMI requirements, new regulatory guides, new generic letters, unresolved safety. issues and new policies and regulations. ~ 2. Meetings-Meetings with the applicant are scheduled for November 2 and 3 to discuss l electric power systems, heat removal systems including natural circu-lati.on capabili. ties, and probabilistic risk and reliability analyses. ~ A brief presentation is tentatively scheduled for the December ACRS meeting to discuss gene' rally CRBRP0's plans for reviewing the CRBRP application. A meeting with the ACRS CRBR Subcomittea (Dr. Carbon, Chainnan) is I tentatively scheduled for December 16 to discuss these plans in more detail. I ENCLOSURE B _ _ _ _ -. ~.. _ _

NEEDED NEAR-TERM ACTIONS BY APPLICANT Update Documents The applicant needs to complete updating the CRBRP ER.(the CRBRP ER was ( updated only in certain limited areas by Amendment IX, dated October 16) i and to update the LMFBR Progrmanatic FES (the LMFBR Programmatic FES has not been updated since 1975). In addition, the applicant needs to update the CRBRP PSAR to reflect outstanding information requests and new regu-latory requirements. CRBRP0's preliminary FIN plan was submitted to PPAS on October 28. The plan reflects an estimated need of $3.1 million for technical assistance in support of the CRBRP review effort for FY 82. Hearing The applicant needs to request the presiding ASLB to reopen the hearing which was suspended indefinitely in 1977 at the applicant's request. POTENTIAL PROBLEMS The following potential problems have been identified by CRBRP0: 1. Recruitment continues to be a problem with respect to staffing the CRBRPO Technical Review Section. Three of the section's six technicai reviewer slots are still unfilled. 2. 0FFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending October 3d, 1981 Low Level Waste Storage at Reactor Sites Based on Commission approval, a generic letter to utilities has bees, prepared for signature by the EDO, informing utilities of the NRC licensing position on the addition of contingency storage capacity for site-generated low level waste. The letter encloses radiological safety guidance, as finalized by NRR, for the design, construction and operation of contingency storage facili-ties. The addition of storage facilities at operating reactor sites can be considered under the provisions of 10 CFR 50.59, to provide for contingency storage of site-generated waste for up to five years. If the proposed stor-age requires specific NRC approval, based on the licensee's 10 CFR 50.59 evaluation or because the plans call for storage in excess of five years, licensing authority for the storage would be obtained through issuance of a Part 30 license. Comment Period for 10 CFR Part 60 The comment period for the technical portion of 1.0 CFR 60, issued as a pro-posed rule, will close on November 5, 1981. Convention on Physical Security The Director, Division of Safeguards, has been invited to present testimony before the House Judiciary C,ommittee regarding a bill to implement the Con-vention on Physical Protection of Nuclear Material. The Convention, which was a successful U. S. initiative, establishes general levels of physical security for international shipments of nuclear materials, provides a frame-work for cooperation among nations in the recovery and return of stolen nuclear material, and defines certain serious offenses involving nuclear material which parties to the Convention are to make' punishable, and for i which offenders will be subject to extcadition or prosecution. 0FFICE OF NUCLEAR REGULATORY RESEARCH IMPORTANT EVENTS FOR THE WEEK ENDING OCTOBER 30, 1981 1. The ninth Water Reactor Safety Research Information meeting was held October 26-30 at the National Bureau of Standards, Gaithersburg, Maryland. The 5-day meeting highlighted research results and accomplishments achieved s during the past year. Division of Risk Analysis 1. Removal of Tritium Recordkeeping and Reporting Requirements On October 28, 1981, the. Executive Director for Operations approved for publication a notice of rulemaking to remove 10 CFR 30.54, 30.55(a),150.18, and 150.19(a) which are recordkeeping and reporting requirements on NRC and Agreement State licensees authorized to possess, transfer, and receive large quantities of tritium. Since the beginning of fiscal year 1976, more than 99 percent of tritium shipped has been transferred ~ by Government-owned, contractor-operated national laboratories. Transfers or receipts of large quantities of tritium are submitted to DOE for tracking in the Nuclear Materials Management and Safeguards System, jointly sponsored by NRC and DOE. 'NRC does not monitor, utilize, or evaluate the tritium reports. The reports are not required for tritium in spent fuel or for tritium produced or possessed within a production or utilization facility incidental to the operation of the facility. Based on these factors, the removal of the recordkeeping and reporting requirements is a minor, nonsubstantive rulemaking action having essentially no effect on NRC and Agreement State licensees. The rule will be effective upon publication in the Federal Register. 2. NREP Procedures, Guide Conference The IEE/NRC Conference on the NREP Procedures Guide (NUREG/CR-2300) was held at the Mayflower Hotel. About 400 attended. The conference appeared to be successful. Safeguards Branch 1. Minor Rule Change to 10 CFR Part 11 A minor rule change amending 10 CFR Part 11, " Criteria and Procedures for Determinirg Eligibility for Access to or Control Over Special Nuclear Material" was approved by the Executive Director for Operations on October 21,1981, and is being publisnad in the Federal Register. , 30 days after publication in the Federal Register, are needed to: specify a date for submission of security plan amendments to the NRC incorporating the requirements of Part 11; specifically identify individuals who are required to submit amended security plans for Commission approval; explicitly allow for the equivalency and acceptability of Department of Energy (DOE), Nuclear Regulatory Commission (NRC), and Department of Defense (D00) clearances granted to their employees; specify dates for individual applications for clearances; and correct the fee schedule for obtaining clearances. Severe Accident Assessment Branch 1. LWR Aerosol Tests A series of wet aerosol tests in the Nuclear Safety Pilot Plant (NSPP) vessel at Oak Ridge have been completed. Seven tests were conducted in a 38 m3 vessel in which uranium metal was oxidized to U 0o using a plasma 2 torch and introduced into a steam environment. The parEmMters that were varied included the amount of aerosol, aging of aerosol, vessel pressure and duration of mixing (fan operation). The objective of the tests was to study the effects of' steam on aerosol behavior. The steam generally increased the rate of fallout with increasing amounts of aerosol plate out on the walls and reduced amounts of aerosol settling on the floor. Scaling factors could cause this effect to differ in full size containment building depending on the location of the release. The test series has run aerosol concentrations to 20-24 g/m3 The results of these tests will be used to verify and improve the aerosol codes NAUA and QUICK. 2. LMFBR-Fuel Aerosol Simulant Tests The first undersodium tuel vaporization test was run successfully in the fuel Aerosol Simulant Test (FAST) vessel. The objective of these tests is to characterize the source term from an energetic core disassembly accident (CDA) for a LMFBR. These tests will also provide information on fuel coolant interactions and the amount of fuel aerosol released from an energetic CDA. In these tests simulated fuel is being vaporized under sodium using a capacitor discharge technique which heats the fuel to temperatures exceeding 40000 K. ITEMS OF INTEREST OFFICE OF INTERNATIONAL PROGRAMS WEEK ENDING OCTOBER 30, 1981 Request'for ' Retransfer of Heavy Water to Argentina On October 28 IP represented NRC at a meeting at the State Department between US Government officials and European officials, including Dr. J. B. Mennicken. Director General of the EURATOM Supply Agency, and representatives from the Central Electricity Generating Board (CEGB) in the U.K. and KFK in West Germany, to discuss a proposed EURATOM request to retransfer U.S.-origin heavy water from West Germany to Argentina. The staff is preparing a report to the Commission on this proposal. Foreign Visits to NRC On Tuesday Dr. Milan Copic of the Yugoslav Josef Stefan Institute (JSI) began a one-week program to participate in the NRC observation of the emergency preparedness exercise at the Surry nuclear plant. Dr. Copic is the Head of the Advisory Group for Nuclear Emergency Preparedness for the Republic of Slovenia and is currently developing emergency preparedness regulations for Yugoslavia in the event of an incident involving the Krsko facility, a 615 MWe PWR. During the exercise at Surry, Dr. Copic was made an integral part of the NRC observation team. On Wednesday Dr=. Sigvard Eklund, Director General of the International Atomic Energy Agency (IAEA), met with Chairman Palladino6. Commissioners Bradfnrd and Roberts, and IP Director J. R. Shea to discuss current nuclear issues. On Wednesday Mr. Chao Chi Huang of the Nuclear Regulatory Division of the Taiwan Atomic Energy Council began a one-week program to participate in the NRC observa-tion of the emergency preparedness exercise at the Grand Gulf nuclear plant. Mr. Huang is one of several foreign regulatory personnel, with immediate responsi-bility for energency preparedness activities in their own countries, who are being selectively scheduled to participate as a part of the NRC observation team in emergency preparedness exercises at U.S. facilities. s. 0FFICE OF STATE PROGRAMS ITEMS OF INTEREST WEEK ENDING OCTOBER 30, 1981 On October 28, a suggested State Radiation Control Act was sent to 0MB for-review and forwarding to the Council of State Governments for inclusion in the Council's next annual publication of SUGGESlED STATE LEGISLATION. This model act, which is a complete updating of the one published in 1961, was prepared by the Office of State Programs in cooperation with the Food and Drug Administration's Bureau of Radiological Health and the_ Conference of Radiation Control-Program Directors, and was reviewed by concerned Federal agencies and State-related organizations. The model act may be enacted by States in its entirety or may be used on a section-by-section basis to amend existing State legislation. The principal additions to the 1961 model act concern the Uranium Mill Tailings Radiation Control Act of 197J, the Low Level Radioactive Waste Policy Act (1980), disposal of low level radioactive waste, user fees, civil penalties, and surety requirements. Deletions involve former provisions for: (t) an administrative organization combining regulatory and promotional activities in the State radiation agencies, and (b) a radiation advisory board, which vested policy and decision making responsibilities in board members who were not public employees and who, in some cases, could be licensees of the Loard. On October 27, 1981 Mr. William B. Menczer, Regional State Liaison Officer, Region III was in Rosemont, Illinois attending a meeting of the Midwest Low Level Radioactive Waste Compact group. The States of Iowa, Ohio, Wisconsin, Minnesota, Nebraska, Missouri, Illinois, Michigan, Kentucky and Kansas were represented. The group reached consensus on the composition of the nine draft compact articles and plans. A final document is to be prepared by January 1982 for introduction into State legislatures by compact member States. On October 28 Mr. Menczer was at the State Emergency Operations Center in Des Moines, Iowa observing an exercise of the State's Emergency Reponse Plan for the Duane Arnold plant. On the evening of October 29 Mr. Menczer attended a meeting with Ron Kucera, Director, Missouri Department of Natural Resources; Robert Schreiver, Director, Missouri Department of Environmental Quality; William Brinck, U. S. EPA; Lee i Keller, U. S.. DOE; and William Crow, NMSS to discuss Federal activities at the six radioactively contaminated sites in the St. Louis metropolitan area. Following the meeting, Mr. Menczer spoke on NRC's Regulatory Framework at a public meeting sponsored by the League of Women 'loters and Missouri Department of Natural Resources. The purpose of the meeting was to inform the public of Federal activities and responsibilities regarding these six sites. Representatives from U. S. 00E, U..S. EPA, U. S. h ~ OFFICE FOR ANALYSIS AND EVALUATION OF OPERATIONAL DATA ITEMS OF INTEREST WEEK ENDING OCTOBER 30, 1981 ~ Briefing on NRC's Operational Experience Review Program A briefing for the Chairman was held on October 30, 1981 on the NRC's program for the collection, assessment and feedback of reactor events and experience. Individual presentations were made by AE0D, IE, NRR, and RES. NMSS provided some additional remarks on their activities regarding the review of operating experience. An overview of the program was presented, including the sources of information, the relative allocation of staff resources and the coordination methods and activities used within the staff and with other organizations. The office presentations focused on the specific responsibilities of the individual offices and theproducts resulting from their review. Meeting with INPO d coordination meeting was held on October 28, 1981 by AE0D with INP0 (R. Haueter, S. Rosen and B. Cohn) to discuss the staff proposed rule and guidancefor revising the LER reporting requirements. The meeting was productive and a number of helpful and constructive comments were reviewed. SECY-81-197 - Proposed Amendment to 10 CFR Part 71 to Restrict Air Transport of Plutonium The Commission, by a vote of 3-2 (Commissioners Gilinsky -and Bradford disapproved) approved a notice of proposed rulemaking which provides mmendments to 10 CFR Part 71 to restrict air shipment of plutonium by air, for publication in the Federal Register. Commissioners Gilinsky and Bradford believe that legislation is required for the exemption of A2 quantities from the container requirements. Commissioner Bradford's separate views will be included in the Federal Register Notice. Commissioner Ahearne would have preferred a less vestrictive alternative such as alternative J of the Value Impact Statement, Enclosure 3, SECY-81-197/197A. A majority of the Commission (Chairman Palladino and Commissioners Ahearne and Roberts) approved a modification deleting the phrase "or due process" from the next to last line of page 3 of the explanation of-the proposed rule. Commissioner Roberts would have preferred that the rule be further modified to contain a list of hearings required to be advisory by APA and those required to be advisory by the NRC's rules. SECY-81-549 - INDEMNIFICATION OF LICENSEES STORING SPENT FUEL AT SITES OTHER THAN THE SITES WHERE THE FUEL WAS IRRADIATED, Memo SECY to Dircks, October 27, 1981 This is to advise you that the Commission (with all, Commissioners approving) has approved publication of a Federal Register Notice (FRN) (Aopendix "B") that would anncunce the Commission's intent to modl, 7 uke's indemnity agreement at McGuire to extend. indemnity coverage to Oconee irradiated fuel stored at the McGuire reactorf 'K majority of the Commission (Chairman Palladino and Commissioners Ahearne and Roberts) has also agreed to a policy authorizing the EDO to handle similar requests on a case-by-case basis, with the Commission being informed of any action taken. In connection with his approval, Commissioner Ahearne provided the following statement: "I assume a request involving transfer of irradiated fuel from one utility to another would not be a 'similar' request and would be referred to the Commission." Although approving the McGuire Amendment, Commissioners Gilinsky and Bradford have disapproved the proposed policy which delegates authority to the EDO. Their statement on this matter is as follows: "We should modify the standard indemnity provision to extend coverage to spent fuel irradiated elsewhere, if the transfer has been approved by NRC. It seems obvious that the key decision ic whether to authoriz'e a transfer. Once a transfer has been authorized, the extension of the Price-Anderson coverage should be automatic." On a related matter, Chairman Palladino and Commissioner Roberts agree with the following statement of Commissioner Ahearne: "As far as I can tell, the only reason we are offering an opportunity for a hearing on the indemnity agreement language is because 6140.9 of our regulation commits us to do so. I do not see the point of having a hearing'on the language of an indemnity agreement and suggest we change the regulations to avoid similar future situations." The Office of State Programs was informed of this action on October 26, 1981. The staff is requested to accomplish the following: 1.
