Dear Dr. Myers:

This confirms the discussion Mr. Ashley and Mr. Woodruff held with Messrs. Willis and Godwin on Or.tober 15, 1981 following our recent follow-up review of the Alabama radiation control program.

The review was-limited to a review of actions taken by the Department in response to our comments and recommendations made to you and Mr. Godwin following our review meeting in January 1981.

I am pleased to report that, in the staff's opinion, the Alabama radiation control program is adeoaate to protect the public health and safety and is compatible with the program of the Nuclear Regulatory Commission and thh other Agreement ' cates. We commend the program's staff in responding with positive actions to our comments and recommendations.

He were pleased to note the addition of one new staff member to the radioactive materials program. This addition increased the staffing ~

level from 0.49 staff years /100 licenses to 0.66 staff years /100 licenses.

We und stand the Department has requested two additional persons in the FY 83 budget to bring the agreement material program staffing level up to our recommended 1.0-1.5 staff years /100 licenses. We are also pleased to learn of the sponsorship of a bill for a fee system to be presented before the State legislature during the February 1982 session and that the system will include fees for licensing and inspection. Approximately two-thirds of all licensees (NRC and Agreement States) pay fees for licensing / inspections.

At the present time at least one-half of the Agreement States either have in effect, or are preparing to have, a fee We urge every effort be made to ensure that these steps are system.

implemented so that tha radiation control program can keep pace with its ever increasing responsibilities in protecting the public health and safety.
