INTERVENOR REOUEST FOR THE ADM1SSION OF THE TRUTH OF A MATTER OF FACT AS REPRESENTED BY CERTAIN DOCLNENTS OF CPCo.
l The enclosed documents, for which I recuest an admission er authenticity, appear to contradict the statement in the prepared testimony of Mr. Gilbert Keeley that "On January 26, 1979 applica-tion of the surcharge to the Diese l Generator Building was com;nence d."
(1). They also contradict Mr. Howell's prepared testimony wh!.h States that the NRC Staff was informed of the preload choice "in early January, some 4 months before the preload was begun." (2)

In acknowledginD the authenticity of the above documents, I recuest that Consumers admit that the apn11 cation of the surcharDe was begun prior to January 26, 1979,and notwithstanding the fact that the first 2 or S feet have bat 1 considered " frost, protection" placed in November 1978, that the actual decision to proceed with the'preload took place December 15, 1978.

o I regret that I did not find these documents earlier. I will await Consumers response in the hopes of being able to include this in my Proposed Findings.
I also promise that this will be the last Admission that I will attempt to include in my Proposed Findings.
Should I find any1other significant information I would consider it my burden to attempt to reopen this portion of the proceeding.
I hope all parties agree that despite its difficulties, this is the most expeditious way to deal with' this matter.
