November 20, 1981 ORDER (Ruling on intervenors' Motion to' Defer)
On November 18,1981, Int.3rvenors filed a " Renewal of Motion to Defer Intervenor's Response to Motion for Sun:r.ary Disposition Pending Completion of Discovery." In that document they again ask +.i at we defer-the due date for their response until all discovery questions are settled rather than setting a date certain for such response as we had previously done.
s In its reply, also dated November 18, L.icensee argues that:
1.
The deferral is unjustified because no clear nexus has been shown between any specific interrogatory and any contention which is the subject of a motion for summary disposition.
2.
Even if such nexus exists, Intervenors can point it out in their reply to summary disposition motions and the Board c'an take cognizance of it in ruling.
Licensee also indicates that it w have no objection to a reasonable extension..

2-We ag'ree with Licensee's position that Intervenors can make their arguments on the necessity for having the specific info.rmation requested i,n their interrogatories when they argue the merits of the motions for summary disposition. The Board will take those. arguments into account in determining whether the issues are ripe for summary disposition.
It is therefore this 20th day of November.1981 ORDERED That Intervenors shall respond to Licensee's Motions for Summary
