Appendix A NOTICE OF VIOLATION Northern Michigan Hospital License No. 21-16732-01 As a result of the inspection conducted on October 23, 1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

License Condition No. 16 requires that licensed material be possessed and used in accordance with the statements, representations, and pro-cedures contained in certain referenced applications and letters.

The referenced letter datec' October 15, 1979, states that cesium-137 brachytherapy sources will be inventoried monthly unless the sources have been in use.

Contrary to the above, cesium-137 brachytherapy which have been stored since approximately September 1980, were not inventoried from January 10, 1981, to October 19, 1981.

This is a Severity Level V violation (Supplement VII).

2.

10 CFR 35.14(e) requires that sealed calibration or reference sources possessed pucsuant to 10 CFR 35.14(d) be tested for leakage and/or con-tamination at intervals not to exceed six months.

Contrary to this requirement, a 220 microcurie barium-133 source and a 198 nicrocurie cesium-137 source were not leak tested from October 9, 1980, to July 31, 1981.

This is a Severity Level V violation (Supplement VII).

3.

License Condition No. 16 requires that licensed material be possessed and used in accordance with the statements, representations, and pro-cedures contained in certain referenced applications and letters.

The referenced application dated December 4, 1975, states on page 2 that the radiation survey detection instruments shall be calibrated every six months.

Contrary to the above, survey instruments including G-M and ion chamber meters were not calibrated from June 19, 1980, to June 16, 1981. A period exceeding six months.

This is a Severity Level V violation (Supplement VII).

The referenced application dated December 4, 1975, states that records

' rill be kept of Medical Isotopes Committee meetings, actions, and recom-

  • 'ndations.

Contrary to the above, records were not maintained of Medical Isotope Comr.ttee Meetings held the second and third quarters of 1980, and the first quarter of 1981.

This is a Severity Level VI violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:

(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under' oath or affirmation. Consideration may be given to extending your response time for good cause shown.
