SUBJECT:

TMI-1 (RESTART)

During the October 14, 1981 oral presentations before the Commission on the issue of management competence, I stated that the Commis-skn would await the Licensing Board's deci-sion on cheating incidents before making its determination on the restart of TMI-1.

I was under the impression at that

. time that it was necessary as a legal matter for us to. wait for this decision before acting on the THI-1 restart.

I am now convinced that my statement should be corrected.

Whether the Commission should, or should not, await resolu-tion of the cheating matter is a question which the Commis-sion has not specifically addressed, and my mind is open on.

It is one which we will need to address when and if the Licensing Board favorably resolves the outstand-ing hardware and emergency planning issues respecting restart.

At that time, we will have the option to request the parties' views on this particular question.

My statement on October 14 unforturately conveyed the message that the Commission had decided the matter.

How-ever, as I have said, I was then under the erroneous impres-sion that the Commission was required to await the Licensing Board's decision on cheating.

Subsequent presentations in the October 14 meeting and my own reflection on the subject make it apparent to me now that the Commission is not required to wait.

So that the parties can be apprised of the contents of this memorandum, I have asked tnat it be served on them.
