Dear Norman:
This will confirm our telephone conversation of early afternoon today when you informed me for the first time that the Aamodts wodld not be able to meet today's deadline for a response to interrogatory No. 1 of Licensee's Second Set of Discovery Requests Addressed to the Aamodts, dated October 2, 1981, although you will be responding today to the only other outstanding interrogatory--No. 2--of the same set.
You stated further that the earliest we could expect to see an answer to our interrogatory No. I would be in the form of'Aamodt pre-pared testimony to be received by Licensee on November 3, 1981.
As you recognize, our interrogatory requests that the Aamodts identify incidents which the Aamodts claim constitute evidence of cheating or possible cheating, and the basis for the claim.
As we further discussed, it is. impossible for Licensee to prepare and file testimony on incidents which the Aamodts claim to constitute cheating, on the very same day when those incidents are first disclosed.
As a result, we have agreed that in recognition of the impossible situation in which your delay in responding places us, that the Aamodts will not object to Licensee's filing of any testimony deemed necessary to respond to Aamodt prepared testimony filed on November 3, 8111200438 811026' gdA PDR ADOCK 05000299 I
