Novernber 4,1981 Beference c$nments to Subpart E of 10 CFR Part 60, NRC Pzuposed Rule, Federal Register, vol. 46, no. 130, July 8, 1981.
Para 60.121, subpara (a), p. 35289 Sme mention should be made conceming special legal considerations for State Water Rights in applicable states.~ 'Ihis~wouicT show cognizance of a vital issue.
Para 60.- 122, subpara (a) and (b). p. 35290
~
" Tectonic processes" in (a) should be considered adequate as covering " structural processes" in (b), themby eliminating the need for subpara (b).
Para 60.122, subpara (a) through (e), p. 35290 For clarity, suggest changing "would not affect or would favorably affect" to "would not affect or would not decmase."
Para 60.122, subpara (f), p. 35290 Suggest adding an additional ground-water characteristic: "(5) ground-water flow paths leading away frm the geologic setting."
s Para 60.122, subparp (i)
Suggest for geodetic accuracy changing " deemed to be the elevation of the lowest point" to "deened to be -the altitude aboye mean sea level of the lowest point."
Para 60.123, subpara (a) (5)
Last words, "that is less than the smallest dinension of :.e fault rupture surface" am somewhat confusing and too pennissive.
Otmpare with subpara (b)(8) which follows.
Suggest mphrasing to avoid ambiguity.
