UCS-NYPIRG RESPONSE TO PETITION OF TI 7'_[
!!ETROPOLITAN TRANSPORTATION AUTIIORITY
~
FOR LEAVE TO INTERVENE In a Petition dated November 3, 1981, the Metropolitan Transportation Authority requested permission to intervene pursuant to 10 C.F.R.
Section 2.715(c) with leave to intervene as a party under 10 C.F.R.
Section 2.714 at such future time as deemed appropriate by the ItTA.
In so doing, the MTA simply identified itself as an " interested State, county, municipality, and/or agencies thereof," and noted that it roccives a substantial portion of its electrical power supply from Indian Point Unit 3.
The Union of ConcerneC Scientists and New York Public Interest Research Group do not object to MTA's participation pursuant to 10 C.P.R.
2.715(c), although we believe that MTA should be required "to indicate with reasonable specificity, in advance of the hearing, the subject matters on which it desires to participate." Such a requirement is particularly appropriate gC)3 s

here, where the MTA has shown only an economic interest in~the i
proceeding and has given no indication whatsoever that it can or will make a useful contribution to the issues of nuclear safety.
UCS and NYPIRG object to granting the MTA " leave to intervene as a party under 10 C.P.R.
2.714 at such future time i
as deemed appropriate by the MTA."
There is no provision in I
the Commission's regulations and no concept of fairness that would permit the MTA such special treatment.
Either it must t
t j
meet the requirements for intervention as of the established deadline, which it has failed to do, or it must meet the recuirements for late-filed intervention under 10 C.P.R.
i
- 2. 714 (a) (1).,*/
We ask that the Board simply admit the MTA as an interested State agency, require it to indicate the subject matters on which it wishes to participate, and deny the request for leave 4
to intervene at a later date.
J
- /We note that the MTA has not stated an interest that is cognizable under the Atomic Energy Act, and therefore has not demonstrated that it would have standing to ir.tervene if it attempted to do so.
