1 In its Pre Fearing Conference Order Dated November 5, 1981, The Atomic Safety and Licensing Board (hareafter AS&LB) directed the Participant Clermont County to continue settlement negotiations with tha Applicant Cincinnati Gas and Electric Co. (hereafter " applicant").

Further the AS &LB directed the County to be prepared to submit a re-vised list of specific and litigable issues and contentions which the County intended to present to the Board in the event all issues were not resolved by settlement negotiations.

On November 10, 1981, representatives of the County end the Applicant met at the offices of the Clermont County Commissioners to discuss the issuas, concerns, needs and requirements of the County, as related to the sufficiency and ability of the County and its agencies to implement and utilize the Clermont County Radiological Emergency Response Plan (hareafter CCRERP), and to attempt to resolve those re-maining issues, concerns, needs and requirements by negotiated settle-ment.

Certain of those issuas ware tentatively resolved; however, cer-tain issues, concerns, naeds and requirements remain unresolved to this time.

At the County's request, the applicant has agreed to provide certain items of information concerning a portion of those un:esolved issues.

Both parties agree to continue negotiations to settle any out-standing differences.

Subse quant to that conference and on November 13, 1981, the unresolved i sues, naeds, concerns and requirements of the County were discuss 3d via a telephone call between the legal representatives of the County and Applicant.

The following list of specific issues, subjects and contentions

constitutes the reasining specific, litigable contentions in issue be-tween the County and the applicant.

SPECIFIC CONTENTIONS OF PARTICIPANT CLERMONT COUNTY WHEREAS, Clermont County and the applicant have been engaged in ongoing negotiations to provide and acquire equipment, training and the technology necessnry for the applicant to satisfy all Rules and Regulations governing Emergency Response Plans; including but not limited to those aspects dealing with monitoring, notification, evacuation), assessment, training, and protective actions, and the maintenance, upkaep, replacement, supplementation, repair associa-ted therewith; and whereas the applicant has provided and agreed to provide some items of equipment deemed necessary by Clermont County to perform its function as imposed by the CCRERP for the assurance of adequate protection of the public and emargency response person-nel, and for the implementation and utilization of the CCRERP; but that certain issues, concerns, needs and requirements necessary for the successful implementation and utilization of the CCRERP so as to provide for the assurance of adequate protection of the public and emergency response personnel remain unresolved; and whereas it is the applicant's primary responsibility to provide and assure the ability of the County to implement, utilize and maintain the Plan and components thereof for tha assurance of adequate protection of the public and emergency response personn'el, The County states the following as catters of contention:

Issuas, concerns, needs and requirements discussed, tentatively agreed upon, but not affirmatively resolved and lacking hinding agreement:

' Sheriff's 1.

Expansion of the Dictaphone Recording and Receiving Communica-tion Equip-communications equipment as now installed and presently exist-men t ing in the Clermont County Sherrif's Office.

Such equippyynt consists of a dual recorder with continuous and simultaneous record and playback capabilities.

It presently has a ten (10) channel " head".

Such equipment requires expansion to a twenty (20) channel " head" in order to assure the capabilities to provida adequate communication among all involved agencies, parties and personnel to assure the implementation and utili-zation of the CCRERP for the protection of the public and emargency response personnel in an adequate manner.

The applicant has agreed to provide for such expansion if, after investigation and study, such expansion is feasable, based upon the condition and capabilities of such equipment.

Failure to expand said equipment or provide identical or similar equipment of equal capability to the expanded equip-mant will fail to satisfy the requirements of 10 CFR 8 50.47, (a) (1), (b) (5), (b) (6), (b) (8), (b) (11) ; 10 CFR 6 50, appendix E, I",D 3, and E, subsection a; and 10 CFR 8 50.34 (b) (6) (v).

No binding agreement or contract has been entered into between the County and applicant to assure such modification or installation so as to satify the above provisions.

Standby Power Generator (ONAN) to be providad to the Backup Pow-Clermont County Sheriff for use in the event of a power loss er Source or outage.

The specifications of said Generator have baen discussed and tentatively agreed upon, but no binding agree-ment or contract has been entered into between the County and the applicant to guarantee the delivery of said generator.

Failure to provide said Generator willi fail to satis-fy those requirements of the Code of Federal Regulations as set out in the preceding section, A.

1 and Appendix E, IV - E 9.

Arrangements have not been made by way of contract Communica-tion Abili-or binding agreement to provide for the capability of communi-ty cation with the Warren County DSA helicopter by way of aerial radio transceiver with adequate communication links with Cler-raont County DSA Emergency Operations Center and the Clermont County DSA mobile communications van.

Failure to provide said capabilities would result in tha failure to satisfy those requirements of the Code of Federal Regulations as set out in the preceding section, A 1, 4.

Arrangements, by way of binding agreement or contract, Communica-tion abili-have not been made to provide for communications between Cler-ty mont County DSA, Emergency Operations Center, Zimmer Power Station - 1. Emergency Operations Facility, Kentucky Department of Emergency Services Emergency Operations Center, and Ohio DSA Emergency Oparations Center, by.way of a telecopier.

Said equipment is required in order to assure the coordi-nation of public information and media releases.

5 The applicant has agreed to provide for temporary avail-ability on an "as necessary" basis, and or to furnish said equipment to Clermont County DSA only in the event that the applicant's offsite Facility and Public notification center is not established prior to ZPS - 1 becoming operational.

Failure to provide for aaid capability on a permanent basis would result in the failure to satisfy those require-ments of the Code of Federal Regulations, 10 CFR S 50.47 (a)

(1), (b) (5), (b) (7), 50.34 (b) (6) (v), Part 50, appendix E, subsection D, 3, subsection E, a, and c.

5.

Arrangements, by way of binding agreement or contract, Communica-tion Abili-have been discussed but not entered into, concerning the follow-ty, Backup ing equipment deemed nacessary by Clermont County for communi-cations purposes:

two (2) amateur radio portable hand held receivers, a.

b. twelve (12) amateur radio base station receiver antennas with coax cable.

The applicant has agreed verbally to provide one (1) amateur radio portable hand held receiver and 6 base station antennas.

Failure to provide said equipmant would result in the failure to satisfy those requirements of the Code of Federal Regulations as set out in the preceding section, A, 1.

The County and the applicant have discussed, but no

6 sponse vehicle for the purpose of conducting monitoring, analysis, and other emergency related responsibilities; Said equipment is as necessary for the operational capa-bility of the Clermont County DSA as the monitoring - analy-sis equipment and is required for purposes of implementing those functions.

The applicant agreed to provide a vehicle or the equivalent of the market value of said vehicle.

It is the position of the County that the vehicle offered was not suf-ficient to perform the function for which it is needed and the County has opted to accept the market value of said vehicle.

Failure to provide said vehicle or the c.aans of obtain-said vehicle would result in the failure to satisfy 10 CFR 9 50.47 (a) (1), (b) (6), (b) (8), (b) (9); Appendix E,

'V D, 3, and E, 2; and 50.37 (b) (6) (v).

7.

The applicant has agreed to provide the following list Communica-tion and of equipment to the County.

However, no binding agreement has Monitoring

B.

Issues, _ concerns, needs and requirements not resolved and remaining as specifi: litigable contentions and issues between the County and the applicant:

1.

The participant, Clermont County, does not have in

Monitoring its possession all monitoring and protective equipment neces-and Protec-tive Equip-sary for the protection of the response personnel and the pub-ment, Control' of Exposure lic as an incident thereof, nor have adequate arrangements been made to provide said necessary equipmant to the County for immediate response purposes.

Specifically, the County now has in its possession for distribution to initial response personnal, 100 TLD Eberline Badges, 300 TLD Eberlina Chips, 18 Scottoramic Face Fesks, 50 Teda - R Ctrtridges, and 18 Full anti contamination person-nel protective suits.

The following additional equipment is necessary for the adequate assurance of the safety and protection of emargency response personnel, and the public as incidental thereto;

such equipment is further essential to the overall emargency response capability of the County:

a.

1350 TLD quartz chips,

b.

450 TLD Badges / holders, l

c.

150 Scottoramic Face Masks, d.

300 Teda - R Cartridges, e.

150 ar.ti - contamination suits

4 Failure to provide said equipment would result in the failure to satisfy 10 CFR S 50.47 (a) (1), (b) (8), (9), (11), 50.37 (b) (6) (v), and 6 50 Appendix E, IV E and F.

2.

Clermont County does not have sufficient monetary capabilities or access to the necessary funds needed to ac-quire that equipment as set out in issue / contention # 1, abova, nor is it the responsibility of the County to provide funds for the purchase of said equipment, where, as here, any and all such equipment is required as an incident of the existence of ZPS - 1 within Clermont County.

Failure to provida the funds for the purchase of said equipment, or in the alternative, to provide said equipment, would result in the failure to satisfy 10 CFR S 50.47 (a) (1),

and the remainder of those sections as set out above.

3.

No arrangements or binding agreemants hcve been entered' Equipment into between the County and the applicant to provide for the and Facility bhintenance maintenance of emergency facilities and equipment to support the emergency response, nor is it the responsibility of the County to provide funds for the maintenance of said facilities where, as here, the requirement for said maintenanc e is required as a direct result or incident of the existence of ZPS - 1 with in Clermont County.

Clermont Coe,ty does not have the monetary capability or

access to the necessary funds needed to maintain or provide for the maintenance of those facilities or equipment.

Specifically, it is the County's position that any and all equipment, regardless of whose possession or control it is in, which is required solely because of the existance of ZPS - 1 within Clermont County, and is used or will be used solely for Zimmer related activities, is the sole responsi-bility of the applicant to maintain, replace, repair, service, insure, and test and install, together with all similar and associated costs, whether such equipmant is now in the County's possession, or to be furnished to the County, and whether or not such equipment is now required or to be required in the future, (see the attached list designated Attachment B. for a list of that equipment required to be maintained, replaced, repaired, serviced, insured, tested and installed by tha applicant),

Failure of the applicant to assuma responsibility for tha maintenance, replacement, repair, servicing, insurance, testing and or installation, together with all similar and associated costs, of said equipment and facilities, would re-sult in the failure to satisfy 10 CFR 8 50.47 (a) (1), (b) (8),

50.34 (b) (6) (iv) and (v), and S 50, Appendix E, IV - E, (a), (b), (c), and (d).

a. conduct periodic exercises to evaluate the major portions of emergency response capabilities, b.

conduct periodic drills to develop and maintain key skills, or undertake to identify deficiencies resulting c.

from exercises and drills, and to correct said de-ficiencies, nor is it the responsibility of the county to do so, where, as here, all such exercises and drills are required to be conducted solely as a result of and as an incidence of the existance of the ZPS - 1 facility in Clermont County.

No arrangements or binding agreements have been entered into between the applicant and the county to provide for con-ducting said drills and or exercises.

Failure of the applicant to arrange for assumption of the financial responsibility for all such required exercises and or drills and associated actions would result in the failure of the applicant to satisfy the requirements of 10 CFR S 50.47 (a) (1), (b) (14); 50.34 (b) (6) (v), and S,50 Appendix E, IV - G.and F.

5.

Clermont County does not have sufficient monetary Maintenance of CCRERP, capabilities or access to the necessary funds needed to en-Equipmant,

No arrangements or binding agreements have been en-tered into between tha applicant and the county to provide for said plan maintenance and other associated responsi-bilities, nor other arrangemants made for compensating the county for funds expended or to be expended.

Failure of the applicant to arrange for said plan maintenance and othar associated responsibilities would result in the failure of the applicant to satisfy the requirements of 10 CFR S 50.47, (a) (1), (b3 (14), 50.34 (b) (6) (v), and S 50, Appendix E, IV - G,and F.

6.

Radiological emargency response training has not

12 into between the applicant and the county to provide for reimbursement of or payment for the costs associated with said training on behalf of the Sheriff's department and or other agencies, nor other arrangemants made for compensa-ting the county for funds expendad or to be expended.

Failure of the applicant to assume financial respon-sibility for those training costs or to make other arrange-ments for providing for said training will result in the lack of said training to those members who may be called upon to assist in an emergency and would result in the failure of the applicant to satisfy the requirements of 10 CFR a 50.47 (a) (1), (b) (1), (3), (6), (11), (15);

50.34 (b) (6) (v), and 50 Appendix E, IV - F.

7.

Clermont county does not have the monetary capa-Zimmer Re-bility or access to the necessary funds required to pro-lated Equip-mant; Main-vide the sole source and assume the sole and entire re-tenancs sponsibility for maintananca of that equipmant which is required solely as a result of the existance of ZPS - 1 in Clermont County even though said equipment is used for other purposes other than Zimmer related purposes, where such use is made possible only as a result of the existance of that facility in Clermont County.

No agreements or binding arrangemants have been entered into between the applicant and the county to share the responsibility or assuma a porti,a of the r

13 responsibility for the maintenance, replacement, repair, servicing, insurance, testing and or installation, together with all other associated costs, of said equipmant.

Clermont county does not possess the responsibility of maintaining, replacing, repairing, servicing, insuring, testing and or installing said equipment, but recognizes the partial benefit derived from the existance and use of said equipment and agrees that some responsibility for the above obligations should be assumed by the county.

It is the casition of.-tha county that this equipment and all of its associated costs should be borne equally by the p.arties.

(A list of said equipment is attached hereto and designated Attachment C).

Failure of the applicant to recognize its responsibility with regard to said equipment and or to provide for the equal sharing of the costs associated with said equipmant would re-sult in the failure of the applicant to satisfy the require-ments of 10 CFR s 50.47 (a) (1), (b)(8k,50.34(b)(6)(iv) and (v), and 9 50 Appendix E, IV - E, (a), (b), (c) nnd (d).

8.

Provision has not been made for nor is there in Monitoring existence any plans, mathods, systems or equipment which Informa-tion, Access would provide the county with the means necessary to conduct or have access to random and weekly samples and information of onsite plant air and water radiation discharge levels as those levels are recorded on the plants monitoring systems,

14 and as necessary for assessment and monitoring of actual or

potential offsite consequences of e radiological emergency condition, and as necessary for the performance of the re-sponsibilities and obligations of the county under the CCRERP and under Ohio Law, so as to provida for the reason-able assurance of adequate protective measures on behalf of the public and emergency response personnel.

Such failure results in the violation of 10 CFR 6 50.47 (a) (1), (b) (9), (11); 8 50.34 (b) (6) (v), and 50 Appendix E, IV - B, D - 3, E - 2.

9.

The Clermont County Emergency Operations Center is Relocation of Emergency Presently located Batavia, Ohio, in a building known as the Operations

Center, National Guard Armory.

Plans currently exist which call for Maintenance of Plan the disposal of the building by the state sometime in the near-future.

In that event it will be necessary ta relocate the Center and all of its contents, in approximately 3 years.

Clermont County does not have th2 financial ability or acess to the necessary financial resources to provide for the removal and transfer of all items rof equipmant and other in-cidentals, the installation of those items of equipment and other incidentals, tha testing of those items of equipment and other incidentcls, and other related costs, should that become n2cessary, where said items of equipment and the use thereof are required solely as a result of and as an incidence of the existance of the ZPS - 1 facility in Clermont County, nor is it the responsibility of the county to provide for the

15 removal and subsequant installation and testing of said equip-ment, and other related operational costs.

No arrangements or binding agreements have been entered into between the applicant and the county concerning the re-moval and subsequant installation and testing of said equip-ment, and other costs related thereto in making that equip-ment operational.

Failure by the applicant to make any such arrangements for the removal, transfer, subsequent installation, testing of said equipment would and will result in the failure to satisfy the requiremants of 10 CFR E 50.47 (a) (1), (b) (4),

(5), (6), (8), (9); 50.34 (b) (6) (v), and B 50 Appendix E, B, C, D, E - a, and G, and would make the CCRERP signifi-cantly deficient and unworkable.

All such conditions as do axist and as outlined above constitute significant deficiencies in the Plan; adequate interim compensating actions have not, and cannot, be taken.
