MEMORANDUM AND ORDER (Cancellir.g Evidentiary Hearing on Transition Period Construction Activities)
On November 10, 1981, the Applicants initiated a telephone conference call to Administrative Judge Bechhoefer to advise of a development affe the hearing on transition-period construction activities which had been scheduled for December 8'-10, 1981 by our Memorandum and Order of October 30, 1981 (LBP-81-54,14 NRC
).
Participating in the call were Jack Newnan and Alvin H. Gutterman for the Applicants, William S. Jordan for CEU, and Edwin J. Reis and Don Sells (Project Manager) for the NRC Staff.
The Applicants advised that they had transmitted a letter to Region IV, NRC, which superseded their earlier letter of October 16, 1981 and sought permission to perform safety-related transition-period activities much more limited in scope than those described in the October 16 letter.

Applicants advised that the newly proposed safety related activities basically reduced the or. going work to maintenance and materials handling activities and that there would be no new safety-related construction activities for about six months.
Specifically, the plans to carry on certain concrete pouring and welding activities had been abandoned. All ongoing work was to be brought to an orderly conclusion within about three weeks.
(The Board on November 13, 1981, received a copy of the new letter '
to Region IV dated November 9,1981; our initial review confirms the description of work provided by telephone by the Applicants.)
As a result of the change in scope of transition-period work to be performed, the parties jointly requested that the evidentiary hearing planned for December 8-10, 1981 be cancelled.
(The NRC Staff advised that the CCANP representative agreed with this request.)
Inasmuch as the activities which were the basis for the Board's determination to hold the Decemb2r 8-10,1981 hearing were not to be performed in the near future (i.e_., during the next six months), the Board Chairman agreed to cancel the l
hearing.
(The other Board members subsequently concurred in this determinatioa.)
The authorization of further discovery in the Board's October 30, 1981 Memorandum and Order is also rescinded.
No change is being made in the schedule for a prehearing conference, which will comence at 9:30 a.m. on December 8,1981 in the Austin Public Library Auditorium, Fourth Floor, 800 Guadalupe, Austin, Texas 78701.
For the foregoing reasons, it is, this 13th day of November,1981 ORDERED 1
