APPENDIX A NOTICE OF VIOLATION City Hospital License No. 15501-01 As a result of the inspection conducted on August 26, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7.1980), the following violations were identified.

A.

License Condition 14 requires that licensed material be used in accord-ance w'th statements and procedures contained in youc application dated January 4, 1978. One statement in your application requires that your Medical Isotope Committee meet at quarterly intervals.

Centrary to the above, tha requirement for your Medical Isotope Committee to meet quarterly was not met in that during 1980 and the first half of 1931, your Medical Isctope Committee met on only three occasions.

This is a Severity Level V Violation (Supplement VII).

B.

License Condition 14 requires that 1-icensed material be used in accord-ance with statements and procedures contained in your application dated January 4, 1978. One procedure in your application. states that when pack-ages containing radioactive materials are received they will be transported as soon as possible to the Nuclear Medicine Department.

Contrary to the above, the requirement to place packages of radioactive material in the Nuclear Medicine Department as soon as possible after.

receipt was not met in that it was determined that packages of radioactive material received on Sunday nights and Monday mornings are routinely allowed to remain on a secretary's desk in Radiology for periods of several hours before being moved to Nuclear Medicine.

This is a Severity Level V Violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tions; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown Under the authority of Section 182 of the Atomic Energy Act of y

1954, as amended, this response shall be submitted under oath or affirmaticn.

The ;esponses directed by this Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, pl 96-511.
