r APPENDIX A' NOTICE OF VIOLATION Veterans Administration Hospital License No 47-03630-02 As a result of the inspection conducted on September 16, 1981,. and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified.
A i:ense Condition 18 requires that licensed material be used in accord-ance with statements, representations and procedures contained in your.
application dated October 1, 1977,'and letters dated April 17, 1978 and November 16, 1978. Your letter of April 17, 1978, states that Dr. Hahn will serve as Radiation Safety Officer.
Contrary to the above, the requirement for Dr. Hahn to serve as Radiation Safety Officer was not met in that Dr. Hahn left your institution in. January 1981 and was not replaced.
This is a Severity Level V Violation (Supplement VII).
B.
License Condition 18 requires that licensed material be used in accord-ance with statements, representations and procedures contained in your application dated October 1,1977, and letters dated April 17, 1978, and November 16, 1978. Your letter of April 17, 1978, states that your Medical Isotope Committee shall meet quarterly.
Contrary-to the above, the requirement for your Medical Isotopes Committee to' meet quarterly was not met in that records indicate only two meetings were held in 1980.
This is a Severity Level V Violation (Supplement VII).
C.
10 CFR 20.207(a) requires that licensed materials stored in an unrestricted area shall be secured from unauthorized removal from the place of storage.
Contrary to the above, the requirement to secure licensed material from unauthorized removal was not met in that drums of radioactive waste were stored on an open porch on your Research Building with no means of security provided to prevent unauthorized removal.
This is a Severity Level V Violation (Supplement VII).
D.
License Condition 14 requires that sealed sources containing licensed material be tested for leakage and/or contamination at intervals not to exceed six months.

License No. 47-03630-02 Contrary to the above, the requirement to test sealed sources for leakage and/or contaminat on at six-month intervals was not met in that a Ni-63 source in use in your Pharmacology Lab has not been tested in the past two years.
This is a Severity Level V Violation (Supplement VII).
E.
10 CFR 20.401(b) requires in part, that records of surveys performed under 10 CFR 20.201(b) to evaluate the radiation hazard incident to the presence, use, release or disposal of materials be maintained.
Contrary to the above, the requirement to maintain records of surveys performed under 10 CFR 20.201(b) was not met in that records of surveys performed to evaluate the radiation hazard of materials prior to their disposal have not been maintained.
This is a Severity Level VI Violation (Supplement VII).
Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notict:, a written statement er explanation in reply, including: (1) admission or deni.nl of the alleced vio:a-tions; (2) the reasons for the violations if admitted; (3) the correc t?ve steps which have been taken and the results achieved; (4) corrective steps unich will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
The responses directed by this Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
