The.U.S. Nuclear Regulatory Commission (the Commission) caused to be published in the Federal Register on Wednesday, October 7,1981 (Vol. 46, No. 194, p. 49688), an Atomic Safety And Licensing Board Memorandum and Order in the Matter of Consolidated Edison of New York and Power Authority i

of the State of New York.

The published memorandum and order, among other things, gives notice of the opportunity. for intervention in a proceeding for the resolution of certain safety issues concerning the Indian Point Units 2 and 3 plants, which proceeding is more fully described in Commission Memoranda and Orders dated January 8, 1981 (CLI-81-1, 13 NRC 1) and September 18, 1981 (CLI-81-22, 14 NRC).

The State of New York has an interest in assuring that all matters pertaining to the safety of these plants and to the energy, environmental i

and economic impacts of shutting down or limiting operation of these plants i

are thoroughly considered in this proceeding.

Under Section 7-101 of tne Energy Law and Section 104 of the

'D Commerce Law of the State of New York, the State Energy Office is given the

responsibility for coordinating regulatory programs of State agencies and instrumentalities which affect atomic energy activities in New York, for developing a coordinated position among State agencies with respect to Federal regulatory matters and for coordinating the participation of the agencies and instrumentalities for the State in the regulatory process of the Federal Government where such Federal process affects atomic energy activities in the State.

Pursuant to Section 2.715(c) of the Commission's Rules of Practice and Section 274 of the Atomic Energy Act of 1954, as amended, and in accordance with the provisions of the Commission's Atomic Safety and Licensing Board Memorandum and Order for Indian Point Units 2 and 3 dated October 7, 1981, the New York State Energy Office hereby petitions on behalf of the State of Kew York and its interested agencies to participate in the noticed proceeding as an interested State.
