Dear Judge Carter:
This is in response to your letter dated October 28, 1981, in which you inquired as to a Staff response to "Intervenor's Revision to Affidavit" i
dated Septencer 13, 1981.. The Staff did not file a response to the revised affidavit. The revised affidavit is only an elaboration of the original affidavit submitted by the Intervenor in its " Petition for Waiver of Coa-aission Regulations" dated April 14, 1981. The only new facts provided in l
the revised affidavit are essentially numbers concerning the nearby popu-i lation and maps showing facility locations. Therefore, the revised affidavit did not alter the Staff's position as stated in the special prehearing conference held on May 1,1981 and the Staff did not believe any further elaboration.was required of its views set forth in the transcript of the prehearing conference. Therein, the Staff stated the Intervenor is requesting a rulemaking and should follow the provisions of 10 C.F.R.

circumstances within the meaning of 10 C.F.R. s 2.753 and the Board should

detailed in 10 C.F.R. 5 2.758(c) and give this matter no further considera-tion.
