Dear Dr. Hester:

We are in complete agreement with your letter of September 10, 1981, that early I

consultation with the Fish and Wildlife Service (FWS) or the National Marine Fisherlas Service (IMFS), in accordance with Section 7 of the Endangered Species l

Act of 1973 (as amended), will help to avoid possible conflicts between Endangered and Threatened species and energy development.

As you are probably aware, the NRC staff fomally requests from your Regional Directors a listing of Endangered and Threatened species which may be present for each specific pra.fset. If a Regional Director so advises our staff that Threatened or. Endangered species are present at a site, then our staff proceeds with a biological assessment. The NRC staff's biological assessment becomes part of its environmental impact statement process and is forwarded to FWS.

If the staff detemines that there is no effect to an Endangered or Threatened species, then consultation is not necessary, unless formally s

requested, by your Regional Directors. If the staff detemines that Endangered

or Threatened species may be affected by an action, then the staff requests in l

writing consultation from your Regional Directors as required by the Endangered Species Act.

i Cur staff is required to initiate this review process as soon as we receive ratification ~ that a major action is being undertaken.

We hope this undary of our activities in relation to the Endangared Species Act will indicate our desire to fulfill our obligations under the Act.
