Pover Authority of the State of New York James A. FitzPatrick Nuclear Power Plant Docket No. 50-333 (License No. DPR-59)

Subject:

PROPOSED IMDOSITION OF CIVIL PENALTIES - $40,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of Forty Thousand Dollars ($40,000) will be issued to the Power Authority of the State of New York on or about November 9,1981.

This action is based on two alleged violations concerning the failure to adhere to Technical Specification requirements for having operable containment leakage detection systems.

This event resulted from the licensee's failure to properly prepare and review surveillance test procedures relating to sample line isolation valves on the drywell continuous atmosphere monitoring system.

At the conclusion of a surveillance test on August 20, 1981, these valves were left closed rendering the system inoperable.

A news release will be issued about the time the licensee receives the Notice.

The State of New York will be informed.

It should be noted that the licensee has not been specifically informed of the enforcament action.

The schedule of issuance and notification is:

Following NRC staff evaluation of the response, the civil penalties may be remitted, mitigated or imposed by Order.
