Dear Ms. Ridgway:
This letter is written in response to the Applicants' Response to Kansans for Sensible Energy Motion to Compel Discovery (October 23, 1981). I am hopeful that we will be able to work out an agreement to obtain the infor mation requested in our interrogatories which were the subject of the Motion to Compel Discovery. As you are obviously aware, since Kansans for Sensible Energy (KASE) contends that the applicants do not have the financial capability to operate and decommission the plant, obtaining financialinformation about the applicants' e present and future financialpositions is essential. I would like to make comments about your response to KASE's motion and then suggest a solution to resolve our differences. My comments about your response to the Motion to Compel Discovery are as follows: (1) It is important that each of the applicants answer separately. You have apparently interpreted our request to mean that we want the information from their " collective position." That is not correct. We l want to know from each about the finar.cial position of each as they view it at thii, time and in the futuie. The documents and financial information in the records of each of the applicants have information that is important to us. As allowed by 10 CFR12.740b(a) we served our l interrogatories on each party. Each party is to answer separately and fully. See 10 CFR s2.740b(b). Joint answers are not allowed without authorization, anu no such authorization was granted. See Nagler v. Admiral Corp.,167 F. Supp. 413 (S.D.N.Y.1958). (2) The interrogatories we submitted were very vecific. We defined the j term " documents" and the term "ider.tify" ad asked the applicants to " identify documents" related to the interrogatories. Thk coupled with our motion meets the requirement that we " state with particularity the grounds and the relief sought." (3) In our interrogatories which are the subject of the motion, we d;.d not ask that documents be produced. Rather, we asked that they be identified so we could determine which of them would be beneficial for us to examine. To date, we have not asked that the documents be made available to us. In your response, you imply you have comphed because the apislicants v ill make them available. That was not the substance of our request. We want to know what the documents are before examining them. (4) We do no: believe that it is possible for an official of Kansas Gas and Electric Company (Gene P. Rathbun) to adequately answer interrogatories about the financial affairs of the other applicants. Even if it was possible to do so, the answers furnished were not specific enough. The person responding for a corporation should be a person who by virtue of his position can obtain the information required to answer. The corporation is to select a corporate officer or employee to gather the information. See In re Folding Carton Antitrust Litigation, 76 F.R.D. 417,419 (E.D. Jh. 1977). Also Mr. Rathbun answered based on his know-ledge and belief. This is not enough. He must attempt to gain the inforination. See, Pilling v. General Motors Corp.,45 F.R.D. 366 (D. Utah 1968). (5) Because the applicants' responses dated September 24, and September 29, 1981, set forth our interrogatories, it is readily apparent which parts of the interrogatories were not answered or not adequately answered. As stated above, this meets KASE's burden of showing with particularity how the applicants failed to adequately respond to the interrogatories and why we contend the answers are not complete. (6) In your response you make several references to "a pencil mark" on the copies of the e:ponses which were attached to our Motion to Compel. Such pencil marks are of no significance other than they represent a cnarking of points that were of interest to me. They do not in any way relate to the motion. (7) Attached is an outline of the information requested in Interrogatories 6,8, and 13. The outline shows specifically the parts of each of those interrogatories which were answered, partially answered, or not answered by each of the applicants. For each of these interrogateries, we asked that the applicant identify documents relating to the other parts of the interrogatory. The outline and the applicant's answer show what documents were identified. It is not possible for us to believe that there are not other documents, i.e., memorandums, financial work papers, letters, sub-schedules, or other materials in the records of each applicant that ought to be identified if the applicant is to meet its obligation to fully answer each interrogatory. An applicant is required to make a thorough investigation to determine adequate answers to an interrogatory. The officer or agent of the applicant must furnish the information available to it. The answer must include facts and knowledge of its agents and any person under its control. The person responding cannot answer on personal knowledge only. See, Wallace v. Shade Tobacco Growers Agricultural 2 L
Assn., Inc., 21 F. R. Serv. 2d 1130 (D. Mass.1975); General Dynamics Corp. v. Selb Manufacturing Co., 481 F. 2d 1204 (8th Cir.1973). I have not made a similar outline for the other interrogatories, but in the interest of resolving this matter, I am willing to confer with you about this and prepare such an outline if Nt will be helpful. Such other outlines will reflect that the applicar:ts have not adequately responded. (8) It should be noted that it is difficult to ask for specific documents because they are all within the control of the applicant. Also, you should appreciate that only the applicant and not KASE can know if all the documents have been identified. Based upon the above comments, I make the following suggestion for resolving this inatter: I have filed a motion with the board requesting that KASE be permitted to reply to your response. We should jointly request that the board's ruling on KASE's motion to compel an answer to the interrogatories and on KASE's motion to reply to your response be held in abeyance until we have attempted to resolve this matter to our mutual satisf action. If we are not able to do so then we will ask the board to rule on the motions. It appears that we should be able to do this because you have not objected to answering but are only objecting to the fact that you do not know how to answer in accordance with our specific requests.
