By Order dated August 31, 1981, this Board required Petitioners to file a more specific affidavit concerning whether "special circumstances exist to permit this' Board to entertatu Petitioner's attack on the validity of the Commission's regu-lations" see Order page 6.
The revised affidavit was timely filed on or about September 13, 1981.
A review of my file indicates that though Interrogatories have been filed that neither staff nor Licensee have filed responses.
If responses were filed, then please send copies to the Board.
If no responses were filed, then absent good cause, the Commission will rule on Petitioner's affidavit.
