November 2, 1981 ORDER PROHIBITING DISCLOSURE OF IDENTITY OF INFORMANT The NRC Staff provided the parties to this reopened proceeding with an expurgated copy of its second. investigation report, dated October 13, 1981.

Unfortunately, the NRC Staff did not expurgate information which could easily disclose the identity of one of the interviewees.

We raised this

. matter with the Staff upon receipt of the expurgated version of the report on or about October 28, 1981 because of the potential.for prejudic; to the affected individual.

At the Board's telephone request, the Staff has ascertained that the individual does not wish his/her identity to be disclosed. This individual is not one of the three individuals 't.ho are presently seeking confidential treatment, and in fact, this individual is at this time in a distinguish-able category.

have been known even by the Licensee and who is not at this time an alleged or even suspected cheater.

Accordingly, to preserve the Special Master's discretion to limit disclosure of the individual's identity, perhaps to those who need to know in order to participate effectively in the hearing, all parties and their representatives are hereby ordered not to disclose to any person (other than an NRC employee) either the identity of the individual or identifying inform tion which the Staff f ailed to delete in the expurgated copies of its re port.

The Staff will supply fully expurgated replacement pages. The pages being replaced which were incorrectly only partially expurgated by the Staff should be destroyed by all parties to this proceeding (except of course, the Staff).

Pursuant to our request of October 30, the NRC Staff is by telephone-infor.ning recipients of the incorrectly expurgated report of the error and of this ruling.
