SECY-81-555 - Request of the State of Illinois for a Hearing on G.E.
Morris License Amendment The Commission, by a vote of 5-0*, approved an ordcr (as_ modified by Commissioner Ahearne) to dismiss as moot an outstanding request by the~ State of Illinois for a hearing on the stated proposed license amendment. The contested portion of the amendment was withdrawn by the licensee when the NRC adopted regulations which essentially authorized the requested conduct.

- Sectior. 201 of the Energy Rect gnization Act, 42 U.S.C. 55841r provides that action of the Commission shall be determined by a " majority vote of the members present." Commissioncr Gilinsky was not present when this item was affirmed, but had previously indicated his approval of the order.
Had i
Connissioner Gilinsky been present, he would have affirmed his prior vote. Accordingly, the formal vote of the Commission was 4-0 in favor i-of the decision.
