, CONSTRUCTION ACTIVITIES IN SOUTH TEXAS OPERATING LICENSE PROCEEDING (DOCKET NOS.

50-498 AND 50-499) 5 In response to the Secretary's Memorandum of June 30, 1981 (subject:

"Ra: sing of Issues Sua Sponte in Adjudicatory Proceedings"), transmitted herewith' are copies of the Licensing Board's Memorandum and Order dated October 30, 1981, in the South Trxas operating license proceeding.

We are forwarding this Memorandum and Order even though we recognize th at the issues raised therein might not be r ec arded as sua sponte issues but, instead, as f alling within the scope of issues already admitted to the proceeding and hence not subject to the reporting requirement imposed by the Commission.

We are aware of the Ratition to Suspend Construction recently filed by CEU with the Commission.

See footnote 3 of our Memorandum and Order.

We have alsa received a letter from the Applicants questioning the course of action outlined in our Memorandum and Order.

(All parties had received adv anced notification concerning the pending issuance of our Memorandum anj Order.)

Notwithstanding that letter, we believe that that course of action is appropriate given the near-term nature of the saf ety-rel ated construction activities with which our Memorandum and Order deals.
