s,

Dear Judge Milhollin:

1 CQ c)

This letter is to inform you that we have agreed pg to allow the NRC Staff an. additional day to reply to our

~

follow-on interrogatories, until October 29, 1981.

CV C)

The circumstances leading up to this are as follows.

C3 We had reached agreement with the Staff at the October 16, C) 1981 meetigg_qf the parties that they would consider our CV t

follow-on interrogatories timely if read over the phone f (j on October 22, 1981, with a written copy to follow.

Although

(

Mrs. Aamodt had indicated to Ms. Swartz at a later point on e

33 j

the 16th that there would as a practical matter probably not

~

I c-be very many follow-on interrogatories, the agreement itself i

C) was in n way nditi ned upon there being any particular

+-

number of follow-on interrogatories.

On the 22nd, however, i

CD Ms. Swartz stated that the incerrogatories would not be l,C$

accepted over the phone.

At this point the only way to (j/

JZ get a written copy in Ms. swartz' hands on the 22nd would s

U) have been to drive all the way down to Washington.

The

} f[ 3s CU problem was resolved when Mr. Gray suggested that service the following day would be accepted if we extended the time to j

reply by one day.

We accepted this offer.

I I

U) l Respectfully submitted,

- Gl\\ O c:iwMD:M)p l
