PRELIMINAlkYSTATEMENT 1. By letter dated September 25, 1972, the Stato of Alabama through its State Health Officer requested permission to participate in any proceeding of the above captioned tratter pursuant to the provisions of 10 CFR Sec. 2.715(c). A copy of thic request is included as Attachment "A" to this motion. 2. BY STIPULATION AND NOTICE OF WITHDRAWAL OF REQUEST FOR HEARING AND PETITION TO INTERVENE dated February 5,1973, (STIPUIATION) the State of Alabama withdrew from these proceedings as an intervenor rursuant to 10 CFR Sec. 2.714. The STIPULATION did not address the request of the State of Alabama to participate pursuant to 10 CFR Sec. 2. 715(c). 3. The Commission's MEh0RANDUM AND ORDER dated January 22, 1973, and the Atomic Safety and Licensing Board's NOTICE AND ORDER FOR PREHEARING CONFERENCE did not reject, prohibit, or otherwise indicate any adverse onfor or finding regarding the September 25,-1972, request of de State of Alabama to participate puraaant to 10 CFR Sec. 2.715(c). l( W il il y
