e Appendix A' NOTICE OF VIOLATION Portage View Hospital License No.' 21-18525,
As a result of the inspection conducted on October 2,1981, and 'in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October.7, 1980),
the following violations were identified:
1.
License Condition No. 12 states licensed material shall be used by, or under the supervision of, Robert B. Neale, M.D.
Contrary to the above, from July 1980, to the date' of this inspection, licensed material has been.used by an individual who is neither under Dr. Neale's supervision nor authorized to use licensed material under your license.
This is a Severity Level IV violation (Supplement VII).
2.
License Condition No. 14 requires that licensed material be possessed and used in accordance with the statements, representations, and pro-cedures contained in the application dated April 19, 1978.
The referenced application dated April 19, 1978, states in" Item 7-that Appendix B'to the Guide for Preparation of Applications for Medical Programs, dated November 1, 1977, will be.followed. Appendix B requires that the Medical Isotope Committee meet quarterly.
Contrary to the above, the Medical Isotope Committee has not met since July 1980.
This is a Severity Level V violation-(Supplement VII).
3.
License Condition No. 14 requires that licensed material be-possessed-and used in accordance with the statements, representations, and pro-cedures contained in the application dated April 19,.1978.
Item No.-10 of the' application dated April 19, 1978,' states the dose calibrator will be calibrated in accordance with Appendix D, Section 2-of the Guide for Preparation of Applications of Medical' Programs, ' dated November 1, 1977. Appendix D,-Section 2' requires that the dose cal-ibrator.be calibrated for linearity quarterly.

Appendix A Contrary to the above requirement, it was determined through statements by licensee representatives and the NRC inspectors review of records that this condition is not being met.
Specifically, the only linearity tests performed were dated April 1979, April and October 1980 and April 1981.
This is a Severity Level V violation (Supplement VII).

10 CFR Section 20.401(a) requires in part, each licensee to maintain film badge records on Form NRC-5 or a record containing all information required in Form NRC-5.
Contrary to this requirement, film badge records did not show social security numbers and birthdates of individuals for which film badge-monitoring is required.
This is a Severity Level VI violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:
(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or a f firmation. Consideration may be given to extending your response time for good cause shown.
