Dear Mr. Williamson:

As provided for in Section III.A.8 of the DOE /NRC Memorandum of Understanding (MOU) for the West Valley Project, you and I can establish detailed working procedures as necessary to implement provisions of the West Valley Demonstration Project Act and the MOU itself. With DOE preparing to assume responsibility for the West Valley facility, there is an area that deserves prompt attention and mutual agreement between us, as discussed below.

During negotiations to develop the MOU, DOE and NRC representatives discussed and agreed that DOE and its contractor, upon assuming control of the site, would continue the maintenance and surveillance programs for the dormant facility that the present operator, Nuclear Fuel Services, follows under the terms of its NRC license. This practice would con-tinue until DOE and its contractor established a basis for any desired changes in these programs. Accordingly, I am enclosing a copy of the.

license, CSF-1, with its Technical Specifications for the West Valley facility.

It is our intent to use these technical specifications and I

conditions of the license, as applicable, for reference in conducting l

HRC monitoring of DOE activities.

I am also enclosing a copy of a safety evaluation report prepared by the NRC staff in 197:' to evaluate the safety of operations for the i

dormant facility. On page 15 of this report the NRC staff has identified those - Technical Specifications which would not apply to the facility in its dormant status. As indicated above, we recognize that as the project proceeds you may identify changes that are necessary and desirable in the present maintenance and surveillance programs as called for in the license.

We reguast that we be consulted on such changes with the opportunity to provide any comments th t we may have. Further, in accor-dance with Section III.A.7 of the MOU, we request that the NRC be informed of any significant abnormal event or situation that occurs or is revealed -

as a result of the maintenance and surveillance programs in order that we can identify any potential radiological danger to public health and safety.

As Dr. Clark has discussed informally with Mr. Ha:nric and Mr. Vondren of your office, we believe that it would be useful to meet with you (perhaps late this month) to discuss the need for any additional working procedures at this time, particularly as related to NRC monitoring activities. We will contact you at a later date to discuss your views on such a meeting and your availability.
