JOINT bDTION Pursuant to published notice by the Nuclear Regulatory Commission, the City of Cincinnati (" City") filed a petition for leave to intervene in the captioned proceeding on the applica-tion of The Cincinnati Gas & Electric Company, et al.
("Appli-cants") for an operating license for the Wm.
H. Zimmer Nuclear Power Station and was admitte'i as a party by the Atomic Safety and I.icensing Board ("Licensi..g Board").
The City and Applicants have entered into a Settlement Agreement, attached hereto, and the City has agreed to withdraw as a party to this proceeding upon the condition that the Licensing Board approve the Agreement, as executed.
According-ly, pursuant to the provisions of said Settlement Agreement, and in accordance with the provisions of 10 CFR $2.759 and the Com-mission's Statement of Policy on Conduct of Licensing Proceed-ings:

Tne City and Applicants hereby move the Licensing Board expeditiously to approve the Settlement Agreement, as executed; 03

The City hereby. requests the Licensing Board for leave to withdraw as a party.to this proceeding and. dismissal of its admitted contentions with prejudice upon approv-al by the ~ Licensing Board of the Settlement Agreement, as executed; 3.
The City and Applicants hereby move the Licensing Board to enter an order approving the withdrawal of the City as. a party to this proceeding and dismissal of its contention with prejudice; 4.
The City and Applicants hereby request that until such

time as the Licensing Board acts upon said agreement, the City's contentions shall be held in abeyance and neither the City nor the Applicants shall be prejudiced by the failure to proceed further before the Board with respect to the admitted contentions of the City.
