Appendix A NOTICE OF VIOLATION St. Michael's Hospital License No. 48-12272-01 License No. 48-12272-02 As a result of the inspection conducted on September 30, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

License No.48-12272-01 1.

License Condition No. 14 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated September 7, 1977; and letters dated October 31, 1978, July 1, 1980, October 9, 1980, and May 27, 1981.

Item No. 11 of the application states that the methods and frequencies for calibration of the dose calibrator as stated in the NRC Draft License Guide, dated February 1976, Appendix C,Section VI, will be followed.

Contrary to the above requirements, annual linearity checks of the dose calibrator were not performed since 1978.

This is a repeat item of noncompliance.

This is a Severity Level V violation (Supplement VII).

License No 48-12272-02 2.

10 CFR 35.22(b) requires spot-check measurements to include the following:

a.

timer accuracy b.

congruence between the tsdiation field and the light field c.

accuracy of all distance measuring devices d.

the difference between the measurement and the anticipated cutput expressed as a percentage difference.

Contrary to the above requirement, it was determined through statements by licensee representatives and the NRC inspectors' review of records that this condition is not being met.

Specifically, your monthly spot-checks have net included the required checks listed above.

10 CFR 35.25(a) requires the licensee to maintain for inspection by the Commisrion, reccids, of the calibration of instruments used to make annual full calibrations of teletherapy equipment.

Contrary to the above requirement, it was determined through statements by licensee representatives that this condition is not being met.

Spec-ifically, on the day of this inspection, the above records were not maintainud for review.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:

(1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid furt.her noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
