By Order dated October 16, 1981, the Comission, in General Electric Coopany (GE tiorris Operation Spent fuel Storage facility (Acendraent to Stel-1266)),
dismissed as noot, the October 15, 1980 request of the State of Illinois for a hearing pursuant to 10 C.F.R. L 2.206 y on the January 23, 1980 anendment proposed by the General Elec.ric Corapany to Silti-1265, to provide interin procedures under which GE could perform certain operational changes, tests, or experiments at the fiorris facility. The Comission dismissed the request for hearing as noot, since on fiovember 14, 1980 GE withdrew that portion of its request for a license amendment y in view of the promulgation of 10 C.F.R. Part 72, which authorizes substantially the same activities as those requested by CE in its proposed license amendment.
In taking this action, the Cor.uaission noted that a June 19, 1981 Cor.vaission inquiry of the State of Illinois as to its intentions with respect to its October 15 request for a hearing received no response. The Comission also noted that its y

s 2.206 is reserved for use in enforcenent proceedings and that a request for a hearing on a Part 70 or Part 72 license should be presented directly to the Comission.
y As part of its January 23, 1980 application for a license anendment, GE also requested that liaterials License Siin-1265 be auended to delete references to an earlier version of its " Consolidated Safety Analysis Report" (CSAR) that was filed as part of its application for renewal of SNM-1265 and to substitute references to the latest CSAR.
