REQUEST FOR APPROVAL TO TERMINATE NMSS STAFF ACTI0ft Off THE AMENDMENT TO SNM-1773 FOR TRANSSHIPMENT AND STCRAGE OF OCONEE NUCLEAR STATION SPENT FUEL AT THE McGUIRE NUCLEAR STATION UNIT 1 SPENT FUEL STORAGE PCOL As you know, the Atomic Safety and Licensing Appeal Board (ASLAB) in its August 10, 1981 decision reversed the October 31, 1980 initial decision of the Atomic Safety and Licensir.g Board concerning an aandment requested by Duke Power Company to SNM-1773 to transship and store spent fuel from its Oconee Nuclear Station in the Unit 1 spent fuel storage pool of its McGuire Nuclear Station and authorized the grant of the amendment.

Originally, Duke Power Company sought amendment to SN!1-1773 pursuant to 10 CFR Part 70 because an operating license for its McGuire plant had not been granted.

In the interim since its application for this amendment was filed, the operating license has been granted. Consequently, this authority is being incorporated directly into the operating license.

I initially discussed this process with Edward Ketchen.EED counsel on this case and Ralph Birkel NRR project manager for the McGuire Nuclear Station.

Then on August 14,1981, I sent them a note with all license conditions for Stel-1773 enclosed including that required by the ASLAB in its decision.

In qy last telephone conversation with Edward Ketchen on September 23, 1981, he informed me that a draft amendment to the McGuire OL has been prepared.

In addition, a staff paper has been prepared by-the Office of State Programs recommending that the Comission use its discretionary authority to extend Price-Anderson coverage to storage of Oconee spent fuel at McGuire in the manner it previously did for storage of Robinson spent fuel at the Brunswick plant.

e Leland C. Rouse 1 - OCT 1981 The Comission's period for review of the ASLAB decision extends to October 1, 1981. Final action on this amendnent by NRR is pending, subject only to action by the Comission. Accordingly, I consider this case closed as far as any further NMSS action is concerned.

I therefore request that you authorize in the indicated space below approval to close this case.
