.as advised of the existence of pending District Court anti-trust litigation between Florida Cities and FPL regarding the Cities' nuclear access claims.
Florida Power & Light Company [FPL) respectfully moves the Commission for leave to lodge the attached October 13, 1981 decision of the United States District Court in that litigation:
Florida Cities v.
Florida Power & Light Company, Case No. 79-5101-Civ.-JLK, S.D.
Fla.
In its decision, the District Court granted FPL's motion for summary judgment of the " nuclear access" claim advanced by the City of Tallahassee.
The decision holds that FPL has no legal obligation to share its nuclear facilities.
FPL reserves the right after further study of the Order to file such other papers as may be appropriate.
