construction permit proceeding, Docket No.

50-471, including those documents listed in response to interrogatory number 76.

(including evacuation, sheltering, and the administration of radioprotective drugs) in any area within the circular zone having a 50-mile radius surrounding the Pilgrim site.

current or proposed licensee / applicant, state, or local emer-gency plans for Pilgrim I or Pilgrim II, or any portion thereof.

persons to the stress associated with nuclear accidents and/or the behavior to be expected of persons participating in protec-tive actions in the event of such an accident.

In our opinion, it is appropriate in this case for the NRC to waive copying charges, purs uant to 5 U.S.C.

5552 (a) (4) ( A) and 10 C.F.R. 59.14a "because furnishing the information can be considered as primarily benefiting the general public" and this office is a state agency to whom furnishing the records without charge is an " appropriate courtesy."

The Massachusetts Attor-ney General represents the Commonwealth of Massachusetts in the NRC licensing proceedings for Pilgrim Unit 2 (NRC Docket No.

50-471), and has an immediate interest and duty in ensuring that adequate radiological emergency plans can be and are developed to ensure the protection, health and safety of the ci tizens of the Commonwealth (see M.G.L.

c.

12, SS 1

et seq.).

The Attorney General has an immediate and real inter es'E in receiving the documents requested herein in order to ade-quately prepare for hearings before the Atomic Safety ano Licensing Board in October, 1981 on the issue of emergency planning.

We understand that under the Freedom of Information Act, you must respond to this request within ten (10) working days, and that your failure to respond within that period of time is considered to be a denial of the request.

Please notify me immediately if you cannot or will not respond within that period.
