On March 26, 1981, Commonwealth Edison Company, on s
alf of Iowa-Illinois Gas & Electric Company and itself
(" Licen see s" ), requested approval to amend the operating licenses for Quad Cities Station, Units 1 and 2, in order to increase these units' spent fuel storage capacity.
The Nuclear Regulatory Commission ("Commis sion") filed notice of
" Consideration of Amendment to Facility Operating License" on April 30, 1981.
Thereafter, petitions for leave to intervene were filed by Quad-City A.T.liance for Safe Energy and Survival ("QASES"), Citizens for Safe Energy ("CSE"), and the Older Americans for Elderly

Rights ( " OAER',' ).
Licensees filed their " Answer To The Petitions To Intervene Of Quad-City Alliance For Safe Energy And Survival, Citizens For Safe Energy and Older Americans For Elderly l
l Rights"
(" Answer") on June 12, 1981.
In their Answer, Licensees described the inadequacies of these organizations' petitions for leave to intervene, in terms of both failing l
l to establish standing under 10 CFR S2.714 (a) and failing to

raise valid contentions pursuant to the requirements of 10 CFR S2. 714 (b). The Nuclear Regulatory Commission Staff
.(" Staff") responded to the petitions for leave to intervene on June 15, 1981.
On June 26, 1981, counsel for Licensees met with the representatives of QASES, CSE and OAER in Rock Island, Illinois.
Based on information supplied at this meeting, Licensees withdrew their objections to QASES' and CSE's standing to intervene in this proceeding by letter to this Atomic Safety and Licensing Board
(" Licensing Board") dated-June 26, 1981.
Since the initial meeting of June 26, 1981, counsel for Licensees and NRC Staff have met with repre-sentatives of CSE and QASES on several occasions in order to arrive at a stipulation setting forth_the issues to be adjudicated in this proceeding.
This effort culminated in the " Stipulation of Issues And Contentions"
(" Stipulation")
which was signed by representatives of CSE, QASES, and counsel for the NRC Staff and Licensees and filed on Octo-ber 2, 1981.
This Stipulation includes two appendices.
Appen-dix A sets ko'rth the contentions as to which CSE, QASES, NRC Staff and Licensees have agreed are appropriate for adjudi-cation. Appendix B contains the contentions which Licensees and NRC Staff oppose.
In accordance with paragraph 5 of the Stipulation, this Memorandum is filed to explain Licensees' opposition to the contentions set'forth in Appendix B of the Stipulation.
Licensees also hereby reassert their objections to OAER's intervention in this proceeding.

Objections To OAER's Participation As A Party In This Proceeding The petition for leave to intervene filed on behalf of OAER must be denied for having failed to satisfy
)
the " interest" and " aspects" requirements of 10 CFR S2.714 (a) and the requirement oi raising one valid contention in accordance with 10 CFR S2.714 (b).

OAER Lacks Standing To Intervene Section 2.714 (a) (2) of the NRC regulations requires that a petition to intervene set forth with particularity the interest of the petitioner in the proceeding.

- 52. 714 (a) (2 ). The Commission has ruled that in order to have standing, a petitioner must adequately allege:
(1) that he has or probably will suffer some injury from the action involved
(" injury in fact" test) ; and (2) an interest which is arguably within the zone of interest to be protected under the Atomic Energy Act.

Under the " injury in fact" test, standing to intervene is conferred upon an organization only when it can show an injury to itself or to its members.

If standing is asserted on the ground that members of the organization will be adversely affected by the proposed 3
action, Licensees and the Licensing Board are entitled to a showing concerning the identity of those members so as to be able to verify the asserted injury.

Moreover, there must be a showing that these members have authorized the group to represent their interests.

I As noted in Licensees' Answer, the petition submitted on behalf of-OAER did not establish that OAER has an adequate interest in this proceeding.
First, the petition for QAER only recounts the number of this organization's members purportedly living in the Cordova area, and does not identify one member who has an interest in this proceeding by name and address.

Second, OAER's petition does not indicate:that OAER has been authorized by its membership to represent its membership's interests, if any, in this proceeding.
- Indeed, OAER is apparently a non-profit organization incorporated to further the rights of elderly Americans..There is no showing, much less a claim, that gither this organization's charter or its membership has authorized participation in NRC proceedings generally or in this proceeding specifically.

Finally, there is no explicit showing that the individual who signed the petition filed en behalf of OAER, 1
Mr. John Smith, had the authority to file the petition.
Mr.
Snaith apparently holds the office of " executive director."
No statement is made as to whether Mr. Smith, in his capa-city as executive director, has the authority to introduce OAER into an administrative proceeding.
Acccrdingly, the petition for leave to intervene has not established OAER's right to participate in this proceeding and must be denied.

OAER Has Not Raised One Valid Contention and Has Not Complied With 10 CFR S2.714 (b)
In addition to being required to demonstrate legal standing, a petitioner for leave to intervene in an NRC proceeding is required by 10 CFR S2.714 (b) to file no later than fifteen days prior to the special prehearing conference "a supplement to his petition to intervene which must include a list of the contentions which petitioner seeks to have litigated in the matter, and the bases for each conten-tion set forth with reasonable specificity."
Petitioners who fail to file a supplement which satisfies the require-l ments of 10 CFR S2.714 (b) with respect-to at least one contention will not be admitted ' a a party into an NRC proceeding.

On September 14, 1981, the Licensing Board resched-uled the special prehearing conference for this proceeding for October 14, 1981.
Accordingly, as noted in the Licen-sing Board's Order, the supplement required by 10 CFR S2.714 (b) sett'7g forth OAER's contentions and the bases therefore was to be filed by September 29, 1961.
OAER has not filed such a supplement.
OAER's petition for leave to intervene does not satisfy the requirements of 10 CFR S2.714 (b).
When OAER's petition for leave to intervene was filed, all that OAER was required to do was to identify the specific aspect or aspects of the subject matter as to which it sought to intervene.
10 CFR S2.714 (a).
Section 2.714 (b) requires that contentions be set forth with both specificity and basis.
These requirements are designed to ensure that "intervenors frame their con-tentions with sufficient precision to show that the issues raised are within the scope of cognizable issues to be considered in an adjudicatory proceeding," as well as i
reasonably inform the parties about issues which will have to be dealt with at the evidentiary hearing.

5-7, fall far short of the requirements for a valid contention established by 10 CFR S2.714 (b).b!
OAER purported contention No. 2 alleges that
" tripling the spent fuel storage at Cordova would dras-tically increase the possible health hazard in the area."
OAER has not stated its reasons for its concerns that the proposed modification will increase health hazards.
This contention does not specify a nexus between the proposed modification and the alleged " health hazard" to the Cordova area, and does not provide a basis for such concerns.
Similarly, OAER purported contention No. 5 claims that " possibilities of environmental pollution e.g.,
- land, Mississippi and atmosphere are further dangers attending any increase in storage of spent fuel at Cordova."
Mere asser-tion that the " increase in storage of spent fuel" will create possibilities of environmental pollution is an inadequate contention.
OAER has not specified the types of environmental pollution the proposed modification will generate, nor the mechanism by which such psllution could be caused.
Since OAER has not provided a basis for contention No.
5, it is inadmissable under 10 CFR S2.714 (b).
OAER also contends, in purported contention No. 6, that recent findings place the Cordova area on a major earthquake fault which " multiplies further the risks of making the Quad-Cities Station a 'large storage area for spent fuel."
This contention also fails to satisfy the 1/The remainder of OAER's purported contentions, Nos.
1, 3-4, 8-10, all raise issues outside the limited scope of this proceeding.

requirements of 10 CFR S2.714(b).
OAER has not stated the basis for this-contention and has not established a nexus between the safe shutdown earthquake (SSE) and operating basis earthquake (OBE) and the proposed modification.
The contention alludes to "recent scientific findings" and "a major carthquake fault line" without identifying either the source of the information or the fault line the Quad-Cities area is purportedly located on.
As noted below in connec-i tion with CSE and QASES contention 12 (Stipulation, Appendix B),
the SSE and OBE for the Quad Cities Nuclear Station were established at the operating license proceeding and are not subject to challenge absent a showing of a material super-vening development or some other special circumstance.

OAER has not made such'a showing.
Finally, in purported contention No.

l alleges that occupational hazards to workers due to "radi-ation emanating from defective fuel" is a matter of concern.
OAER has not defined what is meant by " defective fuel" and has not demonstrated any nexus between the proposed modi-l fication and radiation from such fuel.
Since OAER has not l
specified a concern about " defective" fuel which is causally cennected with the installatie:n o'f high density spent-fuel storage racks, and has not provided a basis for such con-corn, this contention, as with the above-noted OAER conten -
tions, must be rejected pursuant to the requirements of i
l l

Licensing Board Should Not Exercise Its Discretionary Authority To Admit OAER As A Party Finally, the Licensing Board should not exercise its discretionary authority to admit OAER as a party in this proceeding.
First, OAER's participation as a party would not contribute anything substantial to this proceeding. The OAER contentions tihich did raise aspects from which a valid contention could have been drawn, OAER contentions 2, 5, 6,
and 7, are covered by contentions 1, 3, 5,
J' and 6, respec-tivcly, of Appendix A to the Stipulation.
Second, judging by OAER's actions to crte, this organization's interests would apparently be best served by means of a limited appearance statement, and not partici-pation as a full party in this proceeding.
The represen-tative of OAER, Mr. Smith, has exhibited a marked reluctance to deal with either Licensees or the NRC Staff, did r.ot supply information as to the organizational background of OAER or the aspects raised on this organization's behalf, did not participate in the negotiations which culminated in the stipulation (despite the fact he was invited to parti-cipate), and OAER itself has failed to supplement its petition for leave to intervene in accordance with 10 CFR S2.714 (b).
As this organization appears to be more inter-ested in bringing to the attention of the public matters of concern to its membership, as evidenced by the " Statement of 9
JacA Smith, Executive Director of OLDER AMERICANS FOR ELDERLY RIGIITS," dated August 21, 1981, than in adjudicating issues within the limited scope of this proceeding, OAER should make a limited appearance statement under 10 CFR S2.715.
Opposition Tc Contentions Set Forth In Appendix B To The Stipulation-Licensees oppose admission into adjudication in this proceeding the contentions set forth in Appendix B to the stipulation, for the following reasons.
In contention No.
2, CSE and QASES fault Licensees' application for not having considered the possibilities of "a. shutting down the Quad Cities Nuclear Station once the racks presently installed in spent fuel pools are full, or b.
reducing electrical output from the Quad Cities Nuclear Station in conjunction with either energy conservation and pricing alternatives.
. or increasing the use of under-utilized fossil fuel plants.
Contention No. 2 raises issues clearly imper-missible in this proceeding.
Licensees' application requests authorization to modify the Quad Cities Nuclear Station's spent fuel poois in order to increase this Station's interim spent fuel storage capacity.
Licensees have not requested authority to extend the operating life of this station beyond that originally authorized.
The issuance of the 10
F operating licenses for the two Quad Cities units was pre-ceded by a full environmental review, including consideration of the need for the power the station was to generate.

The Licensees' financial capability to'I'plement m
the proposed modification to the spent fuel pools, including the cost of handling, transportation and storage of spent fuel, is not a proper subject for adjudication in this proceeding. There is no basis for'a contemporaneous examination of Licensees' solvency, a matter which was initially examined when the construction permit and original operating licenses 11

In addition, even assuming the newspaper articles raised "new" information, nothing contained in the articles warrants reanalysis of the design basis earthquakes estab-lished for the Quad Cities station.
Commission regulations only require geological structures to be included in the analysis establishing a nuclear plants design basis earth-quakes only when they are either " capable faults" or tectonic structures within 200 miles of the plant site.

Capable faults are faults which have either exhibited movement at or near ground surface at least once during the past 35,000 years or movement of a i
recurring nature within the last 500,000 years.

There is no information in contention Nc. 12 or the newspaper articles indicating that the Mid-Continent Gravity Anamoly, or any of its related minor faults, are
" capable faults."
Indeed, according to at least one of 1
these articles, the Plum River fault has not been active for over 250,000 million years.
Also, while the newspapers indicate that there has been recurring activity along the hewMadridseismiczone, there is no indication that any part of this seismic zone lies within 200 miles of the cuad Cities nuclear station.
In fact., one article supplied by

QASES shows the 200 mile area surrounding the New Madrid seismic zone, and the area is conspicuously confined to southern Illinois.

Accordingly, contention No. 12 must be rejected by the Licensing board for failure to satisfy the basis require-ments of 10 CFR S2. 714 (b).
Wherefore, Licensees respectfully request that the petition for leave to intervene filed on behalf of OAER be denied and that CSE's and QASES' contentions Nos. 2, 7 and 12, set forth in Appendix B to the Stipulation, be disallowed.
