With this letter, Nuclear Fuel Services, Inc. (NTS) subits to the Com-mission an application for wendmnt of Licerse No. GF-1.
his amendmnt, in conjunction with kendmnt 31 issued on Septerber 30, 1981, is required in order that the Depart: rant of Energy (IEE) and the New York State Energy Resear6 and Develo; rent Authority (NYERDA) may carry out the conditions of Section 2(b) (4) 'A) of the West Valley Denonstration Project Act, Ps. L.96-368 (1980).
Bis amendment ter:rinates all rights and responsibilities of HTS under License !b. GF-1 ami transfers to hYERDA all residual rights and responsi-bilities of the licensees upon capletion of the West Valley Denonstration Project. All other information required by the Ccmrission for amendment of an operating licerse is contained in the previous strissions of the licensees under Docket No. 50-201.
De requested amendment which adds a Paragraph 8 to the licerse, is as follows:

!btwithstanding any other prov1siors of this license, all rights and responsibilities of the licensee, Nuclear Fuel Services, Inc. (NFS), under License No. GF-1 are terminated upon DOE assuming exclusive pcssession and control.af the facility. Upon DOE's asst =ption of exclusive possession and control of the facility as provided in Paragra;h 7 above, all refences to
'licersee', 'licersees', 'licersees under this license, as their respective interests under this licerse appear', or 'licersees, as their respective interests under this license appear', shall thereafter refer exclusively to the New York State Energy Research and Develcpmnt Authority.
I understand that hYERDA is prepared to join in this application in con-nection with a settlement between NFS and NYERDA of their contractual disputes, provided that any such concurrence by hYERDA.sy be withdrawn, without prejudice, 811015o077 811o13
