Dear Senator Domenici:
l During my confirmation hearings, you asked that I look into che apparent lack of flexibility on the part of the NRC regarding uranium mill tailings regulations for New Mexico.
The purpose of this letter is to inform you that I have been looking into this matter and to give you an interim report on the status of our actions.
As part of the New Mexico rulemaking, the staff participated in the hearing conducted by the Environmental Improvement Board and pointed out several areas where flexibility'could be utilized.
These suggestions were formalized in a sub-mittal to the Board on' August 6, 1981.
In addition, the NRC staff has been assisting the staff of the Senate Environmental and Public Works Committee in drafting a legislative amendment to the Uranium Mill Tailings Radiation Control Act that would further increase available flexibility in the application of standards -to existing milling facilities.
As noted in my September 9,1981 letter to Senator Simpson, these issues may be somewhat complicated by the amendment to the Nuclear Regulatory Commission's Appropriation Bill for Fiscal Year 1982 (H.R. 4144) offered by Congressman Stratton.
We will continue to work with State and Congressional Staff.
I hope we can satisfactorily resolve this issue in the next few wee-ks.
