Dear Mr. Elliott:
This is in response to your letter dated August 13, 1981, in which you requested pursuant to the Freedom of Information Act, a ccpy of the General Electric Nuclear Reactor Study and its Sub-Task Force Reports (Reed Report).
As explained to you in a telephone conversation with Ms. Carol Ann Reed, of my staff, the Commission had determined to make e copy of the Reed Report available to the public. A copy of that decision and an addendum are enclosed for your information. The General Electric Company thereafter sued the NRC to enjoin disclosure of the Report and a federal district court in an October 31, 1980 order, (copy enclosed) barred disclosure of the Report and its contents by the NRC pending resolution of the'various claims for them. Accordingly, the NRC cannot provide the information you seek. However, the NRC will keep you informed of the disposition of the lawsuit and may be able to respond fully to your request at a later date.
Because of the court's prohibition on disclosure, this matter does not arise under the Freedom of Information Act.
