Fort St. Vrain, Unit No. 1 Early Warning Alert System
Dear Mr. Miller:
We have recently become aware of the change in the July 1, 1981, date for the early warning alert system and the extension of that date to February 1, 1982.
As you are aware we have taken exception to the requirement of an early warning alert system for Fort St. Vrain, and we have set forth our justification in various correspondence to the Emergency Preparedness Group and finally to the Commission.
To date we have received no response to any of our correspondence regarding this matter.
We expressed our concern about the lack of response prior to the July 1,1981, date, and we are again expressing our concern with regard to the February 1, 1982, date.
Our c ncerns and our justification have been before the Nuclear Regulatory Commission for 3
i well over a year now, and without some timely response we cannot hope to meet the various schedules and implementation dates established by the Nuclear Regulatory Commission.
Having absolutely no response at this point in time almost negates any possibility of our meeting the February 1, 1982, date, and it would appear that we will not have any resolution of this matter in the immediate future.
We believe we have met the various response dates required, and we 0
have attempted through meetings with your staff, the Emergency J
Preparedness Group, and the ACRS to obtain a timely resolution. Now we are faced with yet another schedule which in our opinion. will be I
more strongly enforced, and yet we still do not appear to be any closer to a resolution than we were when we first submitted our emergency plan in April, 1980.

- It is recognized that ORNL has been contracted to assist in resolving requirements for Fort St. Vrain, but in the interim, time that is required for us to meet the various schedules has slipped by.
Based on the above we seriously believe that Fort St. Vrain should be exempted from the various schedules that have been established pending final recommendations from ORNL, and that separate schedules be established based on final resolution of the ORNL studies to provide some reasonable response time for Fort St. Vrain to implement various requirements as has been provided for LWR's.
Your immediate attention to this matter is requested to avoid serious impact upon Fort St. Vrain operation.
