AM In response to your manorandun of Septanber 28, 1981 soliciting objections to your participation on the THI-l restart Appeal Board, please be advised that IMIA has strong objections to your participation on this 1.

Board.

Our objections are tmfold. First, from a legal stendpoint, we believe your supervision of the NRC's defense in both the People Against Nuclear Energy v. Nuclear Regulatory Camission, No.1131 (D.C. Cir.), and

'lbree Mile Island Alert, Inc. v. Nuclear Regulatory Comnission, No. 81-1157 (D.C. Cir.) is clear evidence of your existing diiect, personal, and substantial interest in the outcome of the TML restart proceeding. We are particularly appalled that you may be eventually hearing appeals on our financial contention if we should win a remand from the D.C. Circuit upon the timely refiling of our petition. We believe your involvement in the TMIA case alreadt demonstrates unquestionable prejudice toward '1MIA, and we bH Teve that you~ will be incapable of rendering fair rulings and a fair judganent in this case. Further, you are most unclear about your

with whom? You can not expect us to support your assertions of objectivity on the basis of the sketchy infonnation you have provided so far.

1 Second, even apart from thestrictly legal considerations, you should be aware that the people in this area are greatly disturbed by your. appointment.

Whether or not you may view yourself as partial or biased, you are perceived as such by the area residents, who are convinced that you will be unable 'o maintain inpartiality in your rulings. After having f

experienced the trauna of the worst comnercial nuclear accident in this l

nation's history, having been already illegally exposed to krypton, and

having been first promised a full review on the merits of the restart case by the Cmmission only to be told one week before the partial initial decision j

that the Appeal Board must first hear the case, the people in this area have grown extremely distrustful of this entire process. The very least l

these people deserve is total confidence in the tribunal which will hear this appeal. We urge you to restore some minimal integrity to this process by renving yourself as Chairnnn of the ^7 peal Board.
