l B'rown Boveri Electric, Incorporated Distribution Apparatus Division Dccket No.' 99900743/81-01 NOTICE OF NONCONFORMANCE Gased on the results of an NRC inspr ' ion conducted on February 4-5, 1981, it appears that certain of your act, sties were not conducted in accordance with NRC requirements, as indicated below:
Criterion I of Appendix B to 10 CFR Part 50, states in cart:
"The persons and organizations performing quality assurance functions shall have sufficient t
authority and organ {zational freedom to identify quality probleas; to initiate, recommend, or provide solutions; and to verify implementation of solutions.
Such persons and organizations performing quality assurance functions shall i
report to :t management level such that this required authority and organizational freedom, including sufficient independence from cost and schedule when opposed to safety considerations, are provided."
Paragraph 1.2 of Section 1 of the Protective Rel w Operation Quality Assurance l
Manual, dated May 3, 1978, states in part, " Qual ny Assurance functions are organizationally separated from and independent of the various production opera-tions."
Contrary to the above, personnel performing quality assurance functions do not have the required organizational freedom and independence from cost and schedule, l
in that they report directly to manufacturing management and not to the QA manager.
