Licensee is mindful of the Appeal Board's guidance on this subject provided in the McGuire and Vogtle cases (Duke Power Co.

(William B. McGuire Nuclear Station, Units 1 and 2), ALAB-143, 6 A.E.C. 623, 625-26 (1973), and Georgia Power Comp $ny (Alvin W.

Vogtle Nuclear Plant, Units 1 and 2), ALAB-291, 2 1.R.C. 404, 411 (1975)].

On at least one occasion, Licensee has already provided notice of new information to the TMI-1 Licensing Board under the same guiding principles.

See Licensee counsel's letter to the Licensing Board, dated June 4, 1981 (providing a B&W letter on small break LOCA analyses which came to Licensee's attention after this subject matter had earlier been discussed in the hearing).

Licensee is also aware of the Appeal Board's recognition in McGuire that changes occur while a lengthy proceeding is underway, some of which necessitate administrative actions by the NRC Staff which must continue.

See 10 C.F.R. S 2.717 (b) ; McGuire, supra, at 625.

In the instant proceeding, the Licencing Board has is6ued, on the management issues alone, a decision of some 340 pages which in-cludes great deuail on the makeup and workings of Licensee's organi-zt. tion.

It is beyond doubt that a number of personnel and organiza-tional changea (which in Licensee's exp;rience are far more plentiful than design or modification changes) will occur which altar to some extent the picture so precisely painted by the Licensing Board's lengthy decision, particularly given the anticipated length of time this proceeding is likely to pend oefore the NRC in some appellate posture.

Moreover, while materiality may be questionable in most if not all cases, the sheer length of the record and detail of the initial decision arguably makes virtually any organization or per-sonnel changes relevant to this proceeding.

Under these circumstances, Licensee expects there will be occa-sions during tne pendency of this proceeding when changes occur which will raquire a determination of whether, under McGuire, the Appeal Board and parties must be advised.

This determination neces-sarily in the final instance is one of judgment.

It is our intention that the determinations err on the side of unnecessary notices.

While we recognize the burden that inconsequential notices may entail, we intend nevertheless to err in this direction in an attempt to remove all doubts about tha adequacies of Licensee's disclosures.

Even at this time, and as illust*ative of the type of change which we intend to disclose, enclosed is a letter to the NRC Staff from Licensee notifying them of a change in personnel assignments within the GPU Nuclear organization.

In Licensee's view, because of Mr. Finfrock's expertise and experi-ence, he clearly is well qualified to head.GORB and this shift is not material.

Nevertheless, others may have different views, and in any event, it appears to be relevant since Mr. Thorpe did appear before the Licensing Board as head of the GPU Nuclear GORBs, and the position of GORB Chairman as well as Mr. Thorpe's name and background are described in this context in the Initial Decision at paragraph 418.
