9 INTERVENOR'S ANSWER TO LICENSEE'S MOTION TO STRIKE 4

C4"Y Now comes the Citizens for Nuclear Reactor Safety, Inc.,
the Intervenor in the above-captioned matter, and pursuant to 10 C.F.R. 2.730 respectfully opposes as moot the Licensee's Motion to Strike from the record of these proceedings the Intervenor's letter dated August 7, 1981 to the Secretary of the Commission petitioning for a hearing and intervenor status on the Commission's decision to renew the Licensee's Cobalt Materials License No. 19-08330-03.
Said letter has been superseded b y -a Petition to Intervene filed by the Intervenor pursuant to 10 C.F.R.
g 2.714 on August 29, 1981.
Both the letter and said Petition were filed on Docket No. 6931; the Intervenor sent a copy of the letter to the service list in the above-captioned case as a convenient way of apprising all interested parties of its action.
Because the letter is not on Docket No. 50-170 and because it has been superseded by said Petition the Intervenor agrees with the Licensee that the Board lacks the jurisdiction to rule on the relief requested in the letter.

strike said letter from the record since u useful purpcse would thereby be served and since said letter will be relevant to these proceedings if the Commission consolidates them with proceedings on the cobalt license renewal decision on Docket No. 6931.
For these reasons the Intervenor respectfully opposes the Licensee's Motion to Strike and urges the Board to deny said Motion.
