RAMON E. HALL, being first duly sworn, deposes and says:

1.

I am presently employed by the United States Nuclear Regulatory Comission, Region IV, in Arlington, Texas, as Chief, Systems and Technical Section, and as Acting Chief, Engineering and Materials Section, in the Engineering Inspection Branch, Division of Engineering and Technical Inspection, Office of Inspection and Enforcement.

On April 3,1979, an article appeared in the New Orleans States-Item, which reported that three workers employed as concrete masons at the Waterford Unit 3 facility had stated that they witnessed numerous mistakes being made in the concrete work at the facility. The three workers declined to give their names or to give detailed explanations, but stated that the mistakes were serious enough to cause them to worry about the operating safety of the facility.

At the time the abovementioned article was published, I was employed i

by the United States Nuclear Regulatory Commission, Office of Inspection and Enforcement, Region IV, as Chief, Engineering Support Section, Reactor Construction and Engineering Support Branch. Upon the publication of the article, I was asked by William C. Seidle, then Chief, Reactor Construction and Engineering Support Branch, to obtain further information concerning the allegations contained in the article pertaining to mistakes in concrete construction.

On or about April 4,1979, I contacted Mr. Jim Amoss, the staff writer I

on the New Orleans States-Times who had authored the article. Mr. Amoss informed me that the three concrete workers with whom he had spoken were working on the l

Hall Affidavit Page Two Intake Structure, a nonsafety-related structure, but did say their comments were also applicable to prior work on the facility itself. Mr. Amoss did not know by whom the concrete workers were employed.

I advised Mr. Amoss that it was important to obtain specifics to permit pursuit of these allegations and urged him to provide the NRC with any further infomation or allegations which may come to his attention.

On or about April 4, 1979, I prepared a memorandum concerning my discussion with Mr. Amoss, in which I indicated that due to the vagueness of the allegation and the employee's reported relationship to previous safety-related work activities, it would not be practical to pursue this matter further.

A copy of my memorandum is attached hereto as " Exhibit A".

Since the time of my conversation with Mr. Amoss on or about April 4, 1979, I have received no further communication from him or any other person which provides any elaboration, substantiation, or further allegation conce'ning the concrete construction " mistakes" reported in the abovementioned articl3.

7.

To the best of my knwoledge and belief, there is insufficient basis to the allegations contained in the abovementioned article to warrant futher investigation.

SUBJECT:

NEWSPAPER ARTICt.E REGARDING WATERFORD, UNIT 3 DN 50-382 pursuant to your request I contacted the author of the enclosed news-paper article regarding the " allegation" contained in the third colum.

Mr. Jim A oss (504 586 3560) is a staff writer for the New Orleans States Item, the New Orleans afternoon paper. After identifying myself to him, he indicated that he had no further infomation than that pre-s>.nted in the article.. The three concrete workers he talked to were working on the Intake Structure, a nonsafety related structurei but did say their ccm ents also were applicable to prior work on the plant proper. He did not know if they were J. A. Jones or Soh Bros. Workers.

Only J. A. Jones did safety related work at Waterford, Unit 3.

I tried to impress upon him how important it is to obtain sufficient specifics to pemit pumult of all allegations; and that if he does 1

get allegations, we would follow to ccmpletion any he relayed to us.

L His mral obligation to help assure the safety of the Waterford, Unit 3 facility was stressed, as were our statutory chligations. He was given the RIV telephone number should further itan be brought to his attention. Tne Waterford, Unit 3 NCR process' was also explained to hIm.
