Dear i4r. Perry:

Currently pending before the 14RC is an application for an operating license for the subject facility which is located near Burlington, Coffee County, Kansas. A number of persons, organizations and governuental agonices nave intervened or are participating in an ongoing adainistrative procecoing regarding the operating license.

The purpcse of this letter is tc inform you of the offsite energency planning related issue that has been raised in the proceeding (copy enclosed) and of the projected hearing scheduie, so that FElM's review and evaluation and prepa-ration for hearing in those areas of FEHA responsibility (offsite emergency planning) may be undertaken promptly. The itRC 5taff wi11 seek to have FEMA prepare written testinony on the offsite planning aspects of the contention and provide witnesses to support such testimony at the hearing.

Under 10 C.F.R. G 50.47(a) of cne liRC's regulations, no operating license for a nuclear power reactor will be issued unless a finding is made ':y the llRC that the state of onsite and of fs1te energency preparedness provides rea-sonable assurance that adequate protective measures can and will be taken in a radiological caergency (10 C.F.R. 9 50.47(a)(1)). The liRC will base its findings in this regard on a review of the FEt% findings and determinatiens on whether State and local emergency plans are adequate and capable of being iuplemented and on the llRC assessment as to whether the applicant's onsite emergency plans are adequate and capable of being inplemented.

In view of these provisions of the liRC regulations, it will be necessary for the liRC Staff to prepare a written evalustion of the over-all adequacy of emergency preparedness for Wolf Creek. This evaluation will be based in substantial part on fella's findings and determinations, pursuant to Section 11.4 of FEliA/liRC Henorandum and Understanding of liovember 4,1980.

The fikC Staff's evaluation and, thus of necessity, the FElm findings and determinations should be coupleted by April 1982.

> In the interest of getting FEMA's Wolf Creek review underway expeditiously, I suggest that we arrani,e a neeting icvolving the tiRC Staff's Wolf Creek project manager and energency planning personnel and those FEtM personnel who will be involved in the FEiA evaluation for Wolf Creek.

At such a s.ieeting, the NRC Staff will provide its projected detailed scnedule for the i.'olf Creek planning review and its reviews as to the needed supporting reviews ano evaluations from FEiM.

S ENCLOSURE l.ocal governments do not have a workable evacuation plan and the Wolf Creek facility should not be licensert until there is a workable plan and until the governmental bodies in the evacuation area are sufficiently staffed, equipped and funded to successfully carry out evacuation plans.
