Appendix A NOTICE OF VIOLATION Department of the Interior Bureau of Indian Affairs 1425 N. E. Irving Street Portland, OR 97208 License No. 36-15059-01 As a result of the inspection conducted on July 20, 1931, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violations were identified:

A.

10 CFR 19.11(a) requires that each licensee shall post current copies of the following documants: (1) 10 CFR 19 and 10 CFR 20; (2) 4 the license, license conditions, or documents incorporated into a license by reference, and amendments thereto; and (3) the operating procedures applicable to licensed activities.

10 CFR 19.11(b) states that if posting of a document specified in paragraph (a)(1),

(2) or (3) of this section is not practical'e, the licensee may post a notice which describes the document at d states where it may be examined.

Contrary to the above requirements, the above documents were neither posted nor was there a notice which describes the documents and states where they may be examined.

This is a Severity Level VI Violation.

(Supplement VII)

B.

License Condition 16 states that the licensee shall possess and use licensed material in accordance sdth statements, representations, and procedures contained in apolication received February 18, 1977, and letter dated July 6,1977-1.

Item 11. of the application received February 18, 1977, states t

that survey instruments will be calibrated every two years.

Contrary to this requirement, survey instruments are not calibrated every two years. A licensee representative stated that he was not aware of a calibration requirement and that the Civil Defense Agency replaces instruments once every four years.

Section 1.4 of Supplement 15, which was submitted with the application received February 18, 1977, states that re;ords of all radiation protection. surveys shall be retained.

Contrary to this requirement, records of radiation protection surveys performed between July 21, 1978 and July 20, 1981 were not maintained.

Section 4.4(4) of Supplement 15, which was submitted with the application received February 18, 1977, states that all storage facilities should be posted with radiation warning signs which include the person to be notified in an emergency.

Contrary to this requirement, the radiation warning sign posted at the facility where licensed material is stored did not include the name of a person to be called in an emergency.

The above items constitute a Severity Level V Violation (SupplementVII).

C.

License Condition 13.A. requires that each sealed source containing licensed material, other than Hydrogen-3, with a half-life greater than thirty days and in any form other'than gas shall be tested for leakage and/or contamination at' intervals not to exceed six months.

Contrary to the above requirement, a leak test of theLsources contained in a Campbell-Pacific Nuclear Portaprobe Model BR, serial number C72032557, was conducted on January 10, 1979 and was not repeated until December 18, 1979, a period of eleven months.

Another leak test was conducted on the sources in the same gauge on June 2, 1980. The test was not repeated until May 7,1981, a period of eleven months.

This is a Severity Level V Violation.

(Supplement VII).

D.

10 CFR 20.207(a) requires that licensed material stored in an unrestricted area shall be secured from authorized removal from the place of storage.

Contrary to the above requirement, the gauge containing the licensed material is not secured from unauthorized removal from the supply room which is its place of storage. The supply room is an unrestricted area. The Supply supervisor and the mailroom supervisor have keys to the supply room which they provide to their personnel as needed for entry to obtain supplies.

This is a Severity Level VI Violation.

(Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, the Bureau of Indian Affairs, Portland, Oregon is hereby required to submit to this office Whin thirty days of the date of this Notice, a written statement or explanation in reply, includinc-(1) the corrective step. dich have been taksn and the results achieved; (2) corrective steps which will be taken to avoid further items cf noncompliance; and (3) the date when full compliance will be achieve d.

Consideration may be given to extending your response time for good cause shown.

The responses directed by this notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
