i Description The fiRC is conducting a generic rulemaking proceeding to reassess its degree of confidence that radioactive wastes produced by nuclear facil-ities will be safely disposed of, to determine when such disposal will be available, and whether such wastes can be safely stored until they are disposed of (44 FR 61372, October 25,1979).

This rulemaking has been initiated in response to the decision of the U.S. Court of Appeals for the District of Columbia Circuit in State of Minnesota vs. flRC, but it also is a continuation.f previous proceedings conducted by tne Comission (42 FR 34391, July 5, 1977).

Status Approximately sixty-five (65) parties notified the Commission of their intent to participate in this proceeding.

Of these, thirty-two (32) filed written statements of position with the Comission.

Twenty (20) of the participants filed cross-statement.

Twelve (12) parties sub-mitted statements which suggested procedures for future proceeding; The Commission established on May 22, 1980 a working group to advise the Commission on the adequacy of the record compiled in this proceeding.

The Working Group published its summary of the recnrd on January 29, M81.

The Working Group provided the Presiding Officer with an analysis of the participant's suggestions for further procedures and recommended a course of action on April 10, 1981 and May 20, 1981.

The Presiding Officer on June 17, 1981 recommended that the Commission issue an order which set forth procedures for the remainder of the pro-ceeding.

Essentially, his recommendation was that the Commission permit the participants to make oral presnetations before the full five-member Comission. The oral presentations, which are to be preceeded by written statements, would be based on the existing record and would not involve the taking of evidence. The Commissioners woulo have the right to ask questions at any time during the course of the oral presentations.

Future Action The next major milestone is for the Commission to issue an order which I

will set out procedures to be follawed for the remainder of the hearing.
