Dear Ms. Shotwell:
This confims our understanding, which I have read to you by telephone, regarding the ground rules for your infomal questioning of NkC Staff personnel on August 20, 1981:
(1)
Staff does not waive, insofar as formal discovery is concerned, its prior objections to the Commonwealth's interrogatories, and does not concede issues of relevance end admissibility at hearing; (2) questioning will be restricted to those areas directly raised by the Commonwealth's First Set of Interrogatories to the Staff, and Staff participants wil1 be advised to answer all questions within those bounds to the best of their ability; (3) without waiving the applicability of 10 C.F.R. 6 2.720(h), there will be no depositions of any individuals who narticipate in the conference call except to the extent that the Commonwealth needs further infomation in response to its Second Set of Interrogatories.
Thus any potential depositions of these individuals would not involve subjects raised and answered in the conference call.

(4) there will be no tape recording or shorthand transcription of the call.
(5) Staff will, as necessary provide additional personnel for infonnal questioning pursuant to the First Set of Interrogatories to the extent that personnel provided cannot answer the Commonwealth's questions.
It is also understood that you have agreed that all motions pertaining to the First Set of Interrogatories are hereby moot and in essence withdrawn.
