Dear Mr. Halligan:

Pursuant to our agreement during the last prehearing conference, I have researched the ownership of the rail lines that service the Susquehanna Steam Electric Station (SSES).

The Berwick line is owned by the Trustees cf the Eric Lackawanna Railway Company, a railroad corporation in reorganization under Section 77 of the Bankruptcy Act. The line is part of the Conrail System and is operated under contract with the Pennsylvania DepartInent of itanspcctation, which partielly subsidizes the operation. A copy of the mt.sr recent contract is attached.

(Although the document by its terme.xpired in March, it was extended by agreanent through September, 193., and apparcatly will be extended further through Decarber,1981.)

Therefore, the Berwick line is currently subsidized, but not owned, by the Connomrealth. There is apparently some possibility that the line will be purchased by the Co:rmonwealth, using federal funds, state funds, and utility funds, by the end of the year. As long as some state funds are used, title would be with the Cocinomrealth.

The actual rail access line into SSEE was the subject of a hearing before the Pennsylvania Public Utility Ccmission:

In re Application of Erie lackawanna Railway Co., Debtor. and Pennsylvania Power and Light Co., Docket No. 98286.

I note that CAND was icpresent'ed at this hearing. PP&L Exhibit 1 was a map showing the locations of the plant and the rail lines.

Should the Applicant decide in the future to use the Berwick line for the transportation of nuclear material, the condition of the tracts m uld certainly be a valid concern.
